HomeMy WebLinkAboutResolution 92-11RESOLUTION 92 -11 CITY OF LADE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE FINAL PLAT OF STONEGATE PHASE I WHEREAS, the City Council of the City of Lake Elmo has previously considered and approved the preliminary plat of Stonegate; and WHEREAS, the Lake Elmo Planning Commission reviewed a final plat for Stonegate Phase I at its March 23, 1992 meeting; and WHEREAS, the final plat of Stonegate Phase I presented to the City conforms to the City's subdivision ordinance. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Lake Elmo does hereby approve and accept the final plat of Stonegate Phase I as the same as on file with the City Administrator, subject to the following conditions: 1. The developer and the City shall execute a developer's agreement and developer shall deposit such security with the City in the amountas determined by the City Engineer and in a form as approved by the City Attorney. 2. The developer shall dedicate to the City 6.78 acres for parks and trails. The developer is credited with 0.41 acres of parkland dedication since only 6.37 acres is required for dedication in Phase I. This will be used when Phase II is developed. In addition, the developer shall be credited with an amount not to exceed $1,050 for parkland dedication in Phase II for grading of the trails in Phase I. Any remaining park dedication will be a combination of land (trails) and cash to meet code requirements. 3. The developer shall provide a current title binder for Stonegate to the City Attorney for review and approval. 4. The developer shall provide a legal description for the outlet road from Stonegate Phase I thru Phase II to the City Attorney so an easement can be prepared, and said easement should be signed by all record owners or parties who have a mortgagee's interest; and legals and easements for additional cul -de -sac areas. 5. Developer will comply with all requirements set forth in Valley Branch Watershed Permit. BE IT FURTHER RESOLVED, that the Final Plat shall not be executed by the City until the above conditions have been met. Adopted by the Lake Elmo City Council this 2A day of June, 1992.
