RESOLUTION NO. 92 -12
A RESOLUTION VACATING A PORTION OF 34TH STREET
IN THE CITY OF LAKE ELMO
WHEREAS, Mr. David Herreid has submitted to the City of
Lake Elmo a petition praying for the vacation of a portion
of a public street in said City, legally described as
follows:
A vacated portion of 34th Street North in the City of Lake
Elmo recorded by Document Number 719033 on file in the
Office of the County Recorder, Washinton County, Minnesota,
and described as follows:
All that part of the Southwest Quarter
Township 29 North, Range 21 West, City
Washington County, Minnesota, which is
COUNTY AUDITOR'S PLAT NO® 8, according
on file and of record in the Office of
Washington County, Minnesota, describe
of Section 13,
of Lake Elmo,
also known as part of
to the plat thereof,
the County Recorder,
d as follows:
Commencing at a point on the west line of the road
leading from ELMO PARK, as surveyed and platted and now of
record in the Office of the County Recorder in and for said
Washington County, north to Stillwater and St® Paul Road,
104°74 feet north along said road from the northeast corner
of Block Two of said ELMO PARK; thence South 71 degrees 44
minutes 52 seconds West, assumed bearing, parallel with the
north line of said Block Two, ELMO PARK, a distance of 42.15
feet to a point which shall hereinafter be called point "A"
for purposes of this description; thence continuing South 71
degrees 44 minutes 52 seconds West, a distance of 12092
feet; thence northerly, deflecting to the right 104 degrees
45 minutes 19 seconds, a distance of 3 ®31 feet to the point
of beginning of the parcel of land to be described; thence
westerly, deflecting to the left 89 degrees 53 minutes 47
seconds, a distance of 1060 feet; thence southerly,
deflecting to the left 90 degrees 06 minutes 13 seconds, a
distance of 3.73 feet to its intersection with a point that
bears South 71 degrees 44 minutes 52 seconds West from said
point "A "; thence North 71 degrees 44 minutes 52 seconds
East, a distance of 14.57 feet to said point "A "; thence
South 86 degrees 36 minutes 24 seconds West, a distance of
12.50 feet to the point of beginning.
WHEREAS, Said Petition came on for hearing before said
City Council at a regular meeting thereof held Tuesday, July
7, 1992 pursuant to notice thereof published and posted as
required by law; and
WHEREAS, the City Council has reviewed this Petition
with concern for the interest of the public; and
WHEREAS, the portion of 34th Street proposed for
vacation is no longer needed as a public street; and
WHEREAS, the infringing building is at least 70 years
old and has historic value, and it is undesirable to attempt
to move the building out of the right -of -way, and
WHEREAS, for the foregoing reason it appears to be in
the public interest to vacate the street as described above.
NOW, THEREFORE, BE IT RESOLVED that the above described
portion of 34th Street in the City of Lake Elmo be and the
same hereby is vacated.
BE IT FURTHER RESOLVED that the Clerk shall prepare a
Notice of Completing.
Adopted by the City Council of the City of Lake Elmo
this 7th day of July, 1992.
