OF THE CITY OF LAKE ELMO
TO IDENTIFY IN SHORELAND AREAS
NON - CONFORMING SEWAGE TREATMENT SYSTEMS
AND REQUIRE RECONSTRUCTION WHEN PRACTICABLE
WHEREAS, the Lake Elmo City Council has adopted shoreland regulations
consistent with the Minnesota Department of Natural Resources Statewide
Standards for Management of Shoreland Areas; and
WHEREAS, said statewide shoreland management standards require that local
governments develop and implement programs to identify and upgrade sewage
treatment systems that are not in conformance with Minnesota Pollution Control
Agency Rules, Chapter 7080; and
WHEREAS, the Lake Elmo City Council finds that protecting the surface waters
and groundwaters in Lake Elmo from contamination by substandard sewage
treatment systems will promote the health and welfare of the citizens of Lake
Elmo.
NOW, THEREFORE, BE IT RESOLVED, that Lake Elmo will take the following actions
to identify and upgrade substandard sewage treatment systems:
1. Through Chapter 700 of the City Code, a maintenance program is in
place, which involves a systematic inspection and review of existing
on -site sewer systems and the repair or reconstruction if determined
to be needed.
2. Whenever a permit or variance of any type is required for any
improvement on, or use of, property in a shoreland area, a report will
be required on the working condition and operation of the sewage
treatment system. Systems not meeting the current design standards
will be required to be modified or reconstructed.
3. As state shoreland implementation funds become available, the City
will complete a systematic on -site inspection program, including all
properties in shoreland areas and identifying non - conforming or
illegal on --site sewer systems and requiring reconstruction when
appropriate.
