Amended the 19th day of Mar-; 1993 February (corrected cc7- 20 -93) WHEREAS, Minnesota Statutes Chapter 414 is a comprehensive enactment relating to procedures and criteria applicable to municipal incorporation, detachment and annexation proceedings; and WHEREAS, one of the stated purposes of Minnesota Statutes Chapter 414 is to protect the integrity of the land use planning process within incorporated areas; and WHEREAS, the Minnesota Municipal Board, pursuant to the provisions of Minnesota Statutes Chapter 414, has denied the request of the City of Oakdale for further annexation review within Section 32 and Section 33; and WHEREAS, an amendment to the Lake Elmo Comprehensive flan has been approved by the Metropolitan Council which extends the City's Municipal Service Area easterly and allows the City to re- allocate sewer capacity from Section 32 and Section 33 to the newly extended Municipal Service Area; and WHEREAS, such re- allocation is essential to the City of Lake Elmo's efforts to allow reasonable development of property within its community; and WHEREAS, the City of Lake Elmo has adopted development regulations consistent with Metropolitan Council guidelines in order to facilitate reasonable development within the extended Municipal Urban Service Area; and WHEREAS, Senate File 491 and House Fife 220 have been introduced and, if approved, would allow the City of Oakdale to petition the Municipal Board for further annexation review within Section 32 and Section 33; and WHEREAS, the title to Senate File 491 and House File 220 are inconsistent with the content of the bills; and WHEREAS, further annexation review within Sections 32 and 33 would frustrate the City of Lake Elmo's efforts to plan for the reasonable development of property within its community; and WHEREAS, the City of Lake Elmo acknowledges that it would be beneficial for Lake Elmo and Oakdale representatives to meet and discuss ways in which to identify and resolve mutual concerns relating to the development of property located within Sections 32 and 33, NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council is hereby opposed to the passage of Senate File 491 and House File 220, and similar legislation; and hereby respectfully requests that its elected officials oppose such legislation; AND BE IT FURTHER RESOLVED that the Lake Elmo City Council requests that the City of Oakdale direct its representative to withdraw its pending legislation; AND BE IT FURTHER RESOLVED that the Lake Elmo City Council hereby offers to meet with the City of Oakdale City Council in order to identify and discuss matters of mutual concern in connection with the development of property within Section 32 and Section 33.
