A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
DRISCOLL AND DAUGHTERS FOR A RECORDING STUDIO
IN THE AGRICULTURAL ZONING DISTRICT
WHEREAS, Richard K. Driscoll has made application for a Conditional
Use Permit to operate a Recording Studio in the Agricultural Zoning District on
the property described as follows:
That part of the Southeast Quarter (SE 1/4) of Section 35, T29N., R21W.,
lying North of the Northerly right-of-way line of Trunk #12 being the South 627.9
feet of the West 618 feet thereof. This parcel contains 7.9 acres more or less.
This property is commonly known as 10824 Hudson Boulevard.
WHEREAS, the Lake Elmo Planning Commission held a public hearing on
this request on August 9, 1993 and heard no testimony in opposition to this
request; and
WHEREAS, at it August 9, 1993 meeting, the Lake Elmo Planning
Commission, on a vote of 6-1, recommended that the request for a Conditional
Use Permit to operate a Recording Studio in the Agricultural Zoning District be
granted with certain conditions.
NOW, THEREFORE, BE IT RESOLVED that a Conditional Use Permit for
a Recording Studio an the property described above be approved with the
following conditions:
8. Adequate off-street parking shall be provided.
9. Noise generated on-site and measured at any property fine
shall not exceed 60 decibels.
10. Applicant shall submit a site plan showing all structures, and shall
shown landscape plan.
11. Applicant must submit any and all information requested by the
Building Official showing that the site has sufficient room for a
third drain field, and alternate drain field site to service the
Recording Studio.
12. The existing Conditional Use Permit on this property shall
expire.
13. This Conditional Use Permit may be rescinded, after a two week
notice and a public hearing, if the City Council finds that the public
health, safety, or welfare is jeopardized.
