A RESOLUTION GRANTING .A MINOR SUBDIVISION TO
JANET MORGAN/MIKE HENNING
WHEREAS, Janet Morgan and Mike Henning made application to the City of Lake
Elmo for a minor subdivision pursuant to Section 401.042 of the Lake Elmo Municipal
Code of the following described parcel of land:
THE SOUTH ONE -HALF OF THE NORTHEAST QUARTER (S 1/2 OF NE 1/4)
EXCEPT THE NORTH THIRTY -FIVE AND FORTY -EIGHT HUNDREDTHS (35.48)
ACRES THEREOF SECTION TWENTY -FOUR (24), TOWNSHIP TWENTY -NINE (29)
NORTH, RANGE TWENTY -ONE (21) WEST, SUBJECT TO ENCUMBRANCES AND
EASEMENTS OF RECORD
WHEREAS, the Lake Elmo Planning Commission considered this request at a
regularly scheduled meeting on October 25, 1993, and conditionally recommended
approval.
NOW, THEREFORE, BE IT RESOLVED that a minor subdivision is hereby granted
to Janet Morgan and Mike Henning and said minor subdivision shall create the
following described parcels:
PARCEL A (11 00 ACRE
That part of the South one -half of the Northeast Quarter except the north thirty -five
and forty -eight hundredths (35.48) acres thereof of Section Twenty -four (24), Township
twenty -nine (29) North, Range Twenty -one (21) West, described more particularly as
follows:
Commencing at the East 1/4 corner of said Section 24, a found Washington County
Cast Iron Monument; thence S 89 Deg. 49'25" W, bearing based on the Washington
County Coordinate System, a distance of 1969.17 feet along the southerly line of the
Northeast 1/4 of said Section 24 to the POINT OF BEGINNING; thence S 89 Deg.
49'25" W a distance of 654.94 feet along the southerly line of said Northeast 1/4 of
Section 24; thence N 00 Deg. 15'37" W a distance of 730.89 feet along the westerly line
of the Northeast 1/4 of said Section 24; thence N 89 Deg. 41'54" E a distance of 654.94
feet along the southerly line of said north 35.48 acres; thence S 00 Deg. 15'37° E,
parallel with the westerly line of the Northeast 1/4 of said Section 24 a distance of
732.32 feet to the POINT OF BEGINNING. Said parcel is subject to an easement for
road purposes over the westerly 41.48 feet thereof for Legion Avenue North and
subject to an easement for road purposes over the southerly 30 feet for 25th Street
North. Said parcel contains 11.00 acres and is subject to all other encumbrances and
easements of record.
PARCEL B.(32.27 ACRES)
That part of the South one-half of the Northeast Quarter except the north thirty-five
and forty-eight hundredths (35.48) acres thereof of Section Twenty-four (24), Township
Twenty-nine (29) North, Range Twenty-one (21) West, described more particularly as
follows:
Commencing at the East 1/4 corner of said Section 24, a found Washington County
Cast Iron Monument; thence S 89 Dog. 49'25" W bearing based on the Washington
County Coordinate System, a distance of 42.39 feet along the south line of the
Northeast 1/4 of Section 24 to the westerly right-of-way of County State Aid Highway
No. 15 and to a found Washington County right-of-way monument for the POINT OF
BEGINNING; thence S 89 Deg. 49'25" W a distance of 1926.78 feet along the south
line of the northeast 1/4 of Section 24; thence N 00 Deg. 15'37" W a distance of 732.32
feet parallel with the westerly line of the Northeast 1/4 of Section 24; thence N 89 Deg.
41'54" E a distance of 1913.66 feet along the southerly line of said north 35.48 acres to
the westerly right-of-way of County State Aid Highway No. 15; thence S 00 Deg. 03'10"
W a distance of 416.98 feet along the westerly right-of-way of County State Aid
Highway No. 15 to a found Washington County right-of-way monument; thence along a
curve concave to the east an arc length of 314.97 feet (314.90 record) to a found
Washington County right-of-way monument; said curve has a delta angle of 6 Deg.
1013" (6 Deg. 10'08" record) a radius of 2924.79 feet and the chord of said curve
bears S 3 Deg. 01'35" E a distance of 314.82 feet (314.75 feet record); thence S 2 Deg.
34'55" E a distance of 5.09 feet along the westerly right-of-way of County State Aid
Highway No. 15 to the POINT OF BEGINNING. Said parcel contains 32.27 acres
exclusive of County State Aid Highway No. 15 and is subject to a gas pipeline
easement as per Document No. 257261. Said parcel is subject to an easement for
road purposes over the southerly 30 feet of the westerly 472.78 feet and is also subject
to all other encumbrances and easements of record.
BE IT FURTHER RESOLVED, that this minor subdivision is conditioned as follows:
1. Applicant pay a park dedication fee of $700 for the newly created lot.
2. The existing property line which divides the subject properties shall no longer
exist and Parcel A shall be recorded as one single parcel and Parcel B shall be
recorded as one single parcel,
3. The property owner shall grant to the City roadway easements for Legion Avenue
N. and 25th Street N. as shown on the Boundary Survey dated September 24, 1993
and prepared by Kemper & Assoc. Inc.
4. In keeping with the intent of allowing a stack lot, there be no further subdivision of
Parcel B until such time there is improved public access for Parcel A.
5. The city only maintains roads that are improved to City Standards, therefore, it
will be the responsibility of Mr. Henning to plow and perform any other maintenance
needed on the unimproved right-of-way that will access this property.
