Resolution 94-29
A Resolution Granting a Minor Subdivision to
Francis J. Pott and Patricia Hagberg
Whereas, Francis J. Pott and Patricia Hagberg made application to the City of Lake
Elmo for a minor subdivision pursuant to Section 401,042 of the Lake Elmo Municipal Code of
the following described parcel of land: to wit:
All that part of Lot No. Five (5), Block No. Three (3), of LAKE ELMO PARK, IN
THE Village of Lake Elmo, Minnesota, described as follows:
Commencing at the Northeast corner of Lot No. Five (5), Block No. Three (3), of
LAKE ELMO PARK, as now on file and of record in the office of the Register of
Deeds of the County of Washington, in the State of Minnesota; thence South along the
Easterly line of said Lot Five (5), Block Three (3) of LAKE ELMO PARK, for Two
hundred fifty -three and seven hundredths (253.07) feet; thence West at right angles for
Eighty (80.0) feet to the Point of Beginning of this description; thence continuing West
for One hundred twenty (120.0) feet; thence South at right angles for One hundred
sixty -four and two- tenths (164.2) feet to the Northerly line of Lake Elmo Blvd.; thence
Southeasterly along said Northerly line of Lake Elmo Blvd. for One hundred thirty -two
(132.0) feet to its intersection with a line drawn parallel with the last mentioned course
and at a distance of One hundred twenty (120.0) feet Easterly therefrom; thence North
along said parallel line for Two hundred nineteen and three- tenths (219.3) feet to the
point of beginning, and
Lot Five (5) in Block Three (3), LAKE ELMO PARK, according to the plat thereof on
file and of record in the office of the Register of Deeds of Washington County,
Minnesota.
EXCEPTING therefrom that part of said Lot Five (5) described as follows:
Commencing at the Northeast corner of Lot Five (5), Block 3, of Lake Elmo Park,
thence South along the E'ly line of said Lot 5 for 253.07 feet; thence West at right
angles for 80 feet to the Point of Beginning of this description; thence continuing West
for 120 feet; thence South at right angles for 164.2 feet to the N'ly line of Lake Elmo
Blvd.; thence SE'ly along said N'ly line of Lake Elmo Blvd. for 132 feet to its
intersection with a line drawn parallel with the last mentioned course and at a distance
of 120 feet E' ly therefrom; thence North along said parallel line of 219.3 feet to the
point of beginning.
WHEREAS, the Lake Elmo Planning Commission considered the request for a minor
subdivision at its October 24, 1994 meeting and unanimously recommended its approval; and
NOW, THEREFORE, BE RESOLVED that based upon the favorable recommendation
of the Planning Commission, a minor subdivision is hereby granted and said minor subdivision
shall result in the following described parcels:
FRAN & MARY POTT (Torrens Property)
That part of Lot 5, Block 3, LAKE ELMO PARK, according to the plat on file in the
office of the County Recorder, Washington County, Minnesota described as follows:
Beginning at the northeast corner of said Lot 5; thence South 00 degrees 59 minutes 13
seconds East, assumed bearing, along the east line of said Lot 5 a distance of 502.15
feet to the southeast corner of said Lot 5; thence North 63 degrees 41 minutes 42
seconds West along the southerly line of said Lot 5 a distance of 225.05 feet to the
southwest corner of the tract described in Certificate of Title No. 10675, as recorded
and on file in the office of the Registrar of Title, Washington County, Minnesota;
thence North 00 degrees 59 minutes 13 seconds West along the west line of said tract
145.88 feet to the northwest corner of said tract; thence North 05 degrees 50 minutes
07 seconds West 186.48 feet to a point on the north line of said Lot 5 distant 226.00
feet westerly of said northeast corner of Lot 5, as measured along said north line;
thence North 71 degrees 42 minutes 03 seconds East along said north line 226.00 feet
to the point of beginning, containing 1.96 acres, more or less.
HORRIGAN PROPERTY (Torrens Property)
That part of Lot 5, Block 3, LAKE ELMO PARK, according to the plat on file in the
office of the County Recorder, Washington County, Minnesota described as follows:
Commencing at the northeast corner of said Lot 5; thence South 00 degrees 59 minutes
13 seconds East, assumed bearing, along the east line of said Lot 5 a distance of 502.15
feet to the southeast corner of said Lot 5; thence North 63 degrees 41 minutes 42
seconds West along the southerly line of said Lot 5 a distance of 225.05 feet to the
southwest corner of the tract described in Certificate of Title No. 10675, as recorded
and on file in the office of the Registrar of Title, Washington County, Minnesota and
the point of beginning of the line to be described; thence North 00 degrees 59 minutes
13 seconds West along the west line of said tract 145.88 feet to the northwest corner of
said tract; thence North 05 degrees 50 minutes 07 seconds West 186.48 feet to a point
on the north line of said Lot 5 distant 226.00 feet westerly of said northeast corner of
Lot 5, as measured along said north line, and said line there terminate.
The area of this parcel is 1.52 acres, more or less.
Adopted by the Lake Elmo City Council the 15th day of November, 1994.
