COUNTY OF WASHINGTON
RESOLUTION NO, 94-8
1. WHEREAS, Michael Leroy Hilyar and Cheryl Hilyar are the
owners of property located at 8961 37th Street North, Lake Elmo,
Minnesota 55042, which is legally described as:
Lot I & 2, Kenridge Addition, Commonly known as
8961 37th Street, Lake Elmo, MN 55042
(37405-2250)
2. WHEREAS, the City of Lake Elmo has received complaints
from adjoining property owners regarding the type and amount of
exterior storage on the Hilyar Property;
3. WHEREAS, the City of Lake Elmo Building Inspector has
inspected the Hilyar Property and has observed the following types
of materials being stored on the outside of the home:
A. Miscellaneous unlicensed and inoperable vehicles;
B. Containers of what appear to be recyclable cans, bottles
and paper;
C. Boxes;
D. Cardboard;
E. Miscellaneous auto parts;
F. Pieces of wood;
G. Building materials (doors); and
Ha Junk and debris.
4. WHEREAS, such items are clearly visible from adjoining
property and the public street;
5. WHEREAS, the unscreened exterior storage of such items is
in violation of the Lake Elmo City Code;
6, WHEREAS, the City has continuously since August of 1986
advised Mr. and Mrs. Hilyar to clean up their property and
otherwise comply with the City's regulations;
7. NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City
Council hereby declares that the storage of the above - described
items on the exterior of the Hilyar home is a public nuisance and
hereby orders Michael Leroy Hilyar and Cheryl Hilyar to abate such
public nuisance pursuant to Lake Elmo Code Section 1501.060 within
five days of service of a copy of this Resolution.
