Resolution 96 -10
A Resolution Granting a Minor Subdivision
to George S. Dege and Joseph M. Magill
WHEREAS, George S. Dege and Joseph M. Magill have made application to the City of
Lake Elmo for a minor subdivision pursuant to Section 401.042 of the Lake Elmo Municipal Code
of the following described parcel of land; to wit:

The Southwest 1/4 of the Southwest 1/4 of Section 2, Township 29, Range 21 West,
except that part of the South 1/2 thereof lying West of Clear Lake, according to the United
States Government Survey thereof and situate in Washington County, Minnesota.
The South Half of the North Half of the Southwest Quarter (S 1/2 of N/12 of SW 114) and
the West Half of the Southeast Quarter of the Southwest Quarter (W I/2 of SEI /4 of SW
1 /4) all in Section Two (2), in Township Twenty -nine (29) North, of Range Twenty -one
(2 1) West, City of Lake Elmo, Washington County, Minnesota, excepting therefrom the
South One Hundred Fifty -two (152.00) feet of said West Half of the Southeast Quarter of
the Southwest Quarter (W 1/2 of SE 1/4 of SW 1/4) and excepting therefrom all that part of
the said West Half of the Southeast Quarter of the Southwest Quarter (W 1/2 of SE 1/4 of
SWI /4) which lies easterly of the following described line:
Commencing at the northeast corner of said South One Hundred Fifty -two (152.00) feet of
the West Half of the Southeast Quarter of the Southwest Quarter (W 1/2 of SETA of
SWI /4); thence westerly along the north line of said south One Hundred Fifty -two
(152.00) feet, a distance of Twenty -three and Seventy Hundredths (23.70) feet to the point
of beginning of said line to be described; thence northerly a distance of One Thousand One
Hundred Sixty -four and Six Hundredths (1164.06) feet, more or less, to the northeast
corner of said West Half of the Southeast Quarter of the Southwest Quarter (WI/2 of
SE 1/4 of SW 1/4) and said described line there terminating.
The North 388.80 feet of the South Half of the Northwest Quarter of the Southwest
Quarter of Section 2, Township 29, Range 21, Washington County, Minnesota. Subject to
easements, if any, and subject to Keats Avenue North.
WHEREAS, the Lake Elmo Planning Commission considered the request for a minor
subdivision at its May 13, 1996, meeting and unanimously recommended its approval.
NOW, THEREFORE, BE IT RESOLVED that based upon the favorable recommendation
of the Planning Commission, a minor subdivision is hereby granted and said minor subdivision
shall result in the following described parcels.
Parcel A (Magill)
The North 388.80 feet of the South Half of the North Half of the Southwest Quarter of
Section 2, Township 29, Range 21, Washington County, Minnesota. Subject to Keats
Avenue North and other easement, if any.
Parcel B (Dege)
The South Half of the North Half of the Southwest Quarter, except the North 388.80 feet
thereof.
The Southwest Quarter of the Southwest Quarter, except the South Half lying westerly of
Clear Lake.
That part of the West Half of the Southeast Quarter of the Southwest Quarter lying North
of the South 152.00 feet, except that part thereof lying easterly of the following described
line:
Commencing at the northeast corner of said South 152.00 feet; thence westerly, along the
north line of said South 152.00 feet, 23.70 feet to the actual point of beginning; thence
northerly 1164.06 feet to the northeast corner of said West Half and there terminating, all
in Section 2, Township 29, Range 21, Washington County, Minnesota. Subject to
easements, if any.
BE IT FURTHER RESOLVED that said minor subdivision is granted based on the
following conditions:
1. No park dedication fee is required because a new lot has not
been created with this minor subdivision.
2. No further subdivision of the Parcel A will be permitted.
Adopted by the Lake Elmo City Council this 21st day of May, 1996.
