Resolution 96 -14
A Resolution Effecting the Detachment of Certain Lands from the
City of Lake Elmo
and its Concurrent Annexation to the City of Oakdale
At a regular meeting of the Lake Elmo City Council held on Tuesday, July 2, 1996, in the
Lake Elmo City Council. Chambers, 3800 Laverne Avenue N., Lake Elmo, Minnesota,
the City Council resolved:
WHEREAS, the City of Lake Elmo received a petition from Rosemary Armstrong
requesting detachment of 13 acres from the City of Lake Elmo and the concurrent
annexation of same to the City of Oakdale hereto as Exhibit A; and
WHEREAS, the City of Lake Elmo has reviewed this request and does not object
to the concurrent detachment of this property from the City of Lake Elmo and its
concurrent annexation to the City of Oakdale; and
WHEREAS, the City of Oakdale is willing to accept the annexation of the 13
acres petitioned for detachment from the City of Lake Elmo; and
NOW, THEREFORE, BE IT RESOLVED by the Lake Elmo City Council that
the petition for concurrent detachment from Lake Elmo and annexation to Oakdale is
hereby approved based on the following finding of fact:
1. That those certain premises situated in the State of Minnesota, County of
Washington, are described as follows to wit:
The North half (N 1/2) of the East half (E 1/2) of the Southeast
Quarter (SE 1/4) of the Northeast Quarter (NE 1/4) of Section 29,
Township 29 North, Range 21 West, containing ten acres, more or
less.
and
The Northerly three hundred eighty -eight and five tenths (388.5) feet
of the East half (E 1/2) of the Southeast Quarter (SE 1/4) of the
Southeast Quarter (SE 1/4) of the Northeast quarter (NE 1/4) of
Section 29, Township 29 North, Range 21 West, containing three
acres, more or less.

2. The above described property now located in the City of Lake Elmo
abuts the City of Oakdale and is properly subject to concurrent
detachment and annexation by concurrent resolutions of the two
councils of the two municipalities pursuant to Minnesota Statutes
414.461.
3. That this 13 acres has no access from Lake Elmo. Access can be made
from a parcel of land currently in the City of Oakdale owned by
Rosemary Armstrong that abuts the property on the southern border and
continues out to 15th Street in the City of Oakdale.
4. The property is planned to become urban in nature, based on the
adjacent land uses (North, South and West) along with the availability
of urban services to accommodate urban development.
5. Assessments for water and sewer hookup at 15th Street in Oakdale have
been paid by Rosemary Armstrong.
The taxes paid to the City of Lake Elmo on the 13 acres are minimal:
$45.74 for 1996. This constitutes a negligible financial loss for the
City of Lake Elmo.
7. The detachment of this property from Lake Elmo will not impact the
City's plans for the development of adjacent property within the City of
Lake Elmo consistent with its Comprehensive Plan.
That it is the desire of the City of Lake Elmo that the above described
property be concurrently detached from the City of Lake Elmo and
annexed to the City of Oakdale.
9. That it is the desire of the City of Oakdale that the above described
property be concurrently detached from the City of Lake Ehno and
annexed to the City of Oakdale.
l O.That both the Lake Elmo City Council and Oakdale City Council
request the Minnesota Municipal Board to grant the request from
Rosemary Armstrong for the concurrent detachment and annexation of
the above described real property to be effective upon issuance of the
Board's order or at such later date as provided by the Board in its order.
Adopted by the Lake Elmo City Council. this 2ndday of July, 1996.
