City of Lake Elmo <br />Washington County, Minnesota <br />Resolution 96 -27 <br />A Resolution Petitioning the Board of the Browns Creek Water Management <br />Organization to Dissolve the Joint Powers Agreement <br />WHEREAS, the City of Lake Elmo is a party to that certain Joint Powers Agreement to Protect <br />and Manage the Brown Creek Water Management District (herein the "Joint Powers Agreement "); and <br />WHEREAS, it is apparent that the parties to the Joint Powers Agreement are unable to effectively <br />resolve matters of common concern regarding the Browns Creek Watershed; and <br />WHEREAS, the Lake Elmo City Council has determined that it would be in the best interests of <br />the affected residents of the City of Lake .Elmo to dissolve the Browns Creek Water Management District <br />and petition the Minnesota Board of Water and Soil Resources for the establishment of a Watershed <br />District pursuant to the provisions of Minnesota Statute Chapter 103D.201 through 103D.231. <br />NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council hereby petitions the <br />Board of the Browns Creek Water Management to dissolve the Joint Powers Agreement and conduct <br />public hearings for such purpose pursuant to the Joint Powers Agreement. <br />ADOPTED by the Lake Elmo City Council this 3rdAay of September, 1996, <br />Attest: <br />Mary Kue ffner, Ci inistrator <br />
