Resolution 96 -27
A Resolution Petitioning the Board of the Browns Creek Water Management
Organization to Dissolve the Joint Powers Agreement
WHEREAS, the City of Lake Elmo is a party to that certain Joint Powers Agreement to Protect
and Manage the Brown Creek Water Management District (herein the "Joint Powers Agreement "); and
WHEREAS, it is apparent that the parties to the Joint Powers Agreement are unable to effectively
resolve matters of common concern regarding the Browns Creek Watershed; and
WHEREAS, the Lake Elmo City Council has determined that it would be in the best interests of
the affected residents of the City of Lake .Elmo to dissolve the Browns Creek Water Management District
and petition the Minnesota Board of Water and Soil Resources for the establishment of a Watershed
District pursuant to the provisions of Minnesota Statute Chapter 103D.201 through 103D.231.
NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council hereby petitions the
Board of the Browns Creek Water Management to dissolve the Joint Powers Agreement and conduct
public hearings for such purpose pursuant to the Joint Powers Agreement.
