CITE' OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION 97-50 <br />A RESOLUTION APPROVING THE FINAL PLAT OF <br />TAMARACK FARM ESTATES <br />WHEREAS, the Lake Elmo Planning Commission reviewed the preliminary plat of <br />TAMARACK FARM ESTATES at its July 21, 1997 meeting and approved the preliminary plat and plan <br />on a 3 -2 vote, and <br />WHEREAS, the Lake Elmo City Council has previously considered and approved the preliminary <br />plat and plan of TAMARACK FARM ESTATES on August 19, 1997, <br />WHEREAS, the final plat of TAMARACK FARM ESTATES presented to the City Council <br />conforms to the City's Open Space Development Area Ordinance. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council does hereby approve and <br />accept the final plat of TAMARACK FARM ESTATES as the same as on file with the City Administrator <br />subject to the following conditions: <br />1. The park dedication shall be an in. -lieu park fee. <br />2. The storm water detention facilities, drainage areas, and ponds and grading plan must comply with <br />recommendations by the Valley Branch Watershed Distinct and the City Engineer. <br />3. Outlots A and C shall be held by a conservation easement to a qualified land trust. <br />4. Outlot D shall have an easement to the City of Lake Elmo. <br />5. All comments from the City Engineer shall be incorporated into these "Conditions of Approval ". (See <br />letter from Tom Prew, TKDA, dated July 10, 1 997 and September 12, 1997) <br />6. All documents for easements, declarations, association by -laws, maintenance agreements, and <br />development contracts have been submitted for review. <br />7. All trails shall be 8' wide and directly connected to The Fields of St. Croix Development. <br />8. A deed restriction requiring the future preservation of the barn as well as restoration. <br />BE IT FURTHER RESOLVED, that the Lake Elmo City Council approve the single family attached <br />homes subject to the following conditions: <br />I . The Planning Commission shall review and approve the material, color and elevations of the single <br />family attached homes. <br />2. The garages shall be side loading. <br />3. The access drive to the homes shall be a private drive maintained by the owners. <br />4. The space adjacent to 5e Street shall be maintained so that it has visual continuity with the adjacent <br />open space. <br />
