HomeMy WebLinkAboutResolution 97-50CITE' OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION 97-50 A RESOLUTION APPROVING THE FINAL PLAT OF TAMARACK FARM ESTATES WHEREAS, the Lake Elmo Planning Commission reviewed the preliminary plat of TAMARACK FARM ESTATES at its July 21, 1997 meeting and approved the preliminary plat and plan on a 3 -2 vote, and WHEREAS, the Lake Elmo City Council has previously considered and approved the preliminary plat and plan of TAMARACK FARM ESTATES on August 19, 1997, WHEREAS, the final plat of TAMARACK FARM ESTATES presented to the City Council conforms to the City's Open Space Development Area Ordinance. NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council does hereby approve and accept the final plat of TAMARACK FARM ESTATES as the same as on file with the City Administrator subject to the following conditions: 1. The park dedication shall be an in. -lieu park fee. 2. The storm water detention facilities, drainage areas, and ponds and grading plan must comply with recommendations by the Valley Branch Watershed Distinct and the City Engineer. 3. Outlots A and C shall be held by a conservation easement to a qualified land trust. 4. Outlot D shall have an easement to the City of Lake Elmo. 5. All comments from the City Engineer shall be incorporated into these "Conditions of Approval ". (See letter from Tom Prew, TKDA, dated July 10, 1 997 and September 12, 1997) 6. All documents for easements, declarations, association by -laws, maintenance agreements, and development contracts have been submitted for review. 7. All trails shall be 8' wide and directly connected to The Fields of St. Croix Development. 8. A deed restriction requiring the future preservation of the barn as well as restoration. BE IT FURTHER RESOLVED, that the Lake Elmo City Council approve the single family attached homes subject to the following conditions: I . The Planning Commission shall review and approve the material, color and elevations of the single family attached homes. 2. The garages shall be side loading. 3. The access drive to the homes shall be a private drive maintained by the owners. 4. The space adjacent to 5e Street shall be maintained so that it has visual continuity with the adjacent open space. BE IT FURTHER RESOLVED that the City should not execute the Final Plat until the above conditions have been met. ADOPTED, by the Lake Elmo City Council this 16'h f Septg. ber f 97.
