RESOLUTION NO. 98- 28
A RESOLUTION ORDERING IMPROVEMENT, PREPARATION OF PLANS,
AND APPROVING PLANS AND SPECIFICATIONS AND
ORDERING ADVERTISMENT FOR BIDS
FOR THE 1998 OVERLAY PROJECT
WHEREAS, the City Council on April 7, 1998 fixed a date for a Council hearing on the proposed
improvement of-
1998 OVERLAYS
1. STILLWATER LANE
2. 10' STREET LANE
3. JAMLEY AVENUE NORTH
4. JANE COURT NORTH
5. 33RD STREET LANE
6. HILL TRAIL NORTH
7. 33RD STREET AND LAVERNE AVENUE NORTH
8. FIRE STATION AND PARK DEPT. LOTS
WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the
hearing was held thereon the P d.ay of May, 1998, at which all persons desiring to be heard were given an
opportunity to be heard thereon.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKE ELMO,
MINNESOTA:
I . Such improvement is necessary, cost - effective, and feasible as detailed in the feasibility report.
2. Such improvement is hereby ordered as proposed in the Council resolution adopted May 5, 1998.
3. PIans and specifications have already been prepared by Tom Prew, TKDA, engineer for such
improvement and pursuant to Council resolution, a copy of which plans and specifications is
attached hereto and made a part hereof, are hereby approved and shall be filed with the City Clerk.
4. Th City Clerk shall prepare and cause to be inserted in the official paper and in the Construction
Bulletin an advertisement for bids upon the making of such improvement under such approved
plans and specifications. The advertisement shall be published for two weeks, shall specify the work
to be done, shall state that bids will be opened and considered by the Council at on May 29,
1998, in the Council chambers of the City Hall, and that no bids will be considered unless sealed
and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond, or certified
check payable to the clerk for 5% of the amount of such bid.
