P WAIO.,yqq <br />City of Lake Elmo <br />Washington County, Minnesota <br />Resolution 98- 32 <br />A Resolution Vacating That Portion of Hill Trail North. <br />Adjacent to Lots 415, 416, 417, 418, Lanes DeMontreville Country Club <br />WHEREAS, at a regular meeting of the Lake Elmo City Council, Washington County, Minnesota held on <br />May 5, 1998, a petition was presented to the City Council praying for the vacation of the property legally <br />described as follows: <br />A tract of land described as follows: Beginning at the most southerly corner of Lot <br />415; thence along the southeasterly lines of Lots 415, 416, 417, 418 and vacated <br />North Shore Lane to the centerline of said vacated North Shore Lane; thence <br />southeasterly along the southeasterly extension of said centerline to its intersection <br />with aline drawn parallel with and 60.00 feet northwesterly from the northwesterly <br />lines of Lots 310, 311 and 312; thence southwesterly along said parallel line to its <br />intersection with the southeasterly extension of the southwesterly line of said Lot <br />415; thence northwesterly along said southeasterly extension to the point of <br />beginning. <br />according to the survey and plat thereof on file and of record in the office of the <br />Register of Deeds of Washington County, Minnesota, excepting and reserving to <br />the State of Minnesota, in trust for the taxing districts concerned, all minerals and <br />mineral rights, as provided by Iaw. <br />WHEREAS, said Petition came on for hearing before the Lake Elmo City Council on May 5, 1998 <br />in the City Hall pursuant to Notice thereof published. and posted as required by law; and <br />WHEREAS, the City Council has reviewed this Petition with concern for the interests of the <br />public; and <br />WHEREAS, that part of Hill Trail North proposed for vacation has never been opened or used for <br />a public street and it is improbable that there will ever be any public need. for said street; moreover, by <br />vacating the same, the property will be returned to the tax rolls and would enhance the taxable value of all <br />the lands abutting thereon or affected thereby; and <br />WHEREAS, for the foregoing reasons, the City Council. deems it to be in the publics interest to <br />vacate part of Hill Trail North. <br />
