Adjacent to Lots 415, 416, 417, 418, Lanes DeMontreville Country Club WHEREAS, at a regular meeting of the Lake Elmo City Council, Washington County, Minnesota held on May 5, 1998, a petition was presented to the City Council praying for the vacation of the property legally described as follows: A tract of land described as follows: Beginning at the most southerly corner of Lot 415; thence along the southeasterly lines of Lots 415, 416, 417, 418 and vacated North Shore Lane to the centerline of said vacated North Shore Lane; thence southeasterly along the southeasterly extension of said centerline to its intersection with aline drawn parallel with and 60.00 feet northwesterly from the northwesterly lines of Lots 310, 311 and 312; thence southwesterly along said parallel line to its intersection with the southeasterly extension of the southwesterly line of said Lot 415; thence northwesterly along said southeasterly extension to the point of beginning. according to the survey and plat thereof on file and of record in the office of the Register of Deeds of Washington County, Minnesota, excepting and reserving to the State of Minnesota, in trust for the taxing districts concerned, all minerals and mineral rights, as provided by Iaw. WHEREAS, said Petition came on for hearing before the Lake Elmo City Council on May 5, 1998 in the City Hall pursuant to Notice thereof published. and posted as required by law; and WHEREAS, the City Council has reviewed this Petition with concern for the interests of the public; and WHEREAS, that part of Hill Trail North proposed for vacation has never been opened or used for a public street and it is improbable that there will ever be any public need. for said street; moreover, by vacating the same, the property will be returned to the tax rolls and would enhance the taxable value of all the lands abutting thereon or affected thereby; and WHEREAS, for the foregoing reasons, the City Council. deems it to be in the publics interest to vacate part of Hill Trail North. Tierney /Lea Petition Page 2 NOW, THEREFORE, BE IT RESOLVED that part of Hill Trail North as dedicated in the plat of Lane's DeMontrevilIe Country Club Addition described above be, and the same hereby is, vacated. BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice of Completion of these proceedings which shall contain the name of the City, and the identification of the vacation, a statement of the time of completion thereof, and a description of the real estate and land affected thereby. Such Notice shall be presented to the Washington County Auditor who shall enter the same in his transfer records and note upon the instrument over his official signature the words "entered in the transfer records." The Notice shall. then be filed with the County Recorder, all as required by Minnesota Statutes.
