RESOLUTION NO. 98-38
A RESOLUTION AMENDING RESOLUTION NO 97 -51, RELATING TO
THE HAMLET ON SUNFISH LAKE.
WHEREAS, the City adopted Resolution No. 97 -51 on September 16, 1997 and;
WHEREAS, the Minnesota Land Trust decided to accept lots for a conservation easement which
were different than those described in Condition No. 4 of resolution No. 97 -51; and
WHEREAS, the decision of the Minnesota Land Trust regarding its acceptance of certain
property for conservation easement affected the legal description of the property which would be
available to the City for open space easements.
NOW, THEREFORE, BE IT RESOLVED that conditions No. 4 and No. 5 of Resolution No.
97 -51 are hereby amended to read:
4. A conservation easement on outlots A, B, D, H and K, shall be given to a qualified land
trust and the City of Lake Elmo.
A conservation easement on outlots C, E, G and J of the hamlet on Sunfish Lake shall be
given to the City of Lake Elmo.
A separate public utilities and right -of -way easement on outlots I & F shall be given to
the City of Lake Elmo.
Adopted by the City of Lake Elmo this- 7"' day of July, 1998
