CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 98-67 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO LINDA KUESTER <br />FOR A STATE LICENSED DAY CARE AND LEARNING CENTER <br />WHEREAS, Linda Kuester has made application for a Conditional Use Permit in the R3- <br />Manufactured Home Park Zoning District for a state licensed day care and learning center, located at <br />Cimarron Park, 901 Lake Ehno Avenue North, Lake Elmo, Minnesota. <br />The property is legally described as: <br />'The West 10 rods of the Northeast Quarter (NW '/4) of the Northeast Quarter (NE ' /A); <br />All that part of the North one half of the Northwest Quarter (NW '/4), Section 36, <br />Township 29, Range 21; All that part of the South one half of the Northwest Quarter <br />(NW 1/4) of the Southwest Quarter (SW ' /a) of the Northeast Quarter (NE 1/4), all in <br />Section 36, Township 29, Range 21, lying Northerly of the proposed Interstate <br />Highway No. 94, County of Washington, State of Minnesota, except Tract No. 1 <br />and Tract No. 3. <br />WHEREAS, the Application was reviewed and recommended for approval by the Planning <br />Commission at a public hearing on November 23, 1998. <br />WHEREAS, the Application, the recommendations of the Planning Commission, and the <br />recommendations of the Staff were reviewed and the Application was approved by the City Council on <br />December 1, 1998. <br />NOW, THEREFORE, the City Council makes the following Findings: <br />1. The Conditional Use Permit is consistent with the standards for Conditional Use Permits specified <br />by Section 300.06, Subd. 4A. of the City Code. <br />FURTHER, BE IT RESOLVED, that a Conditional Use Permit is issued to Linda Kuester for a state <br />licensed day care and Ieaming center subject to the following conditions: <br />I . The Conditional Use Permit is issued to Linda Kuester, and is not transferable as to person or <br />location without City approval. <br />2. The Conditional Use Permit shall be reviewed annually consistent with City procedures for annual <br />Conditional Use Permit reviews. <br />3. The Conditional Use Permit shall remain valid only while the use and facility remains licensed for <br />day care by the State of Minnesota. Revocation of State licensing shall constitute automatic <br />revocation of the Conditional Use Permit without further notice, hearings or process. <br />4.
