RESOLUTION NO. 98-67
A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO LINDA KUESTER
FOR A STATE LICENSED DAY CARE AND LEARNING CENTER
WHEREAS, Linda Kuester has made application for a Conditional Use Permit in the R3-
Manufactured Home Park Zoning District for a state licensed day care and learning center, located at
Cimarron Park, 901 Lake Ehno Avenue North, Lake Elmo, Minnesota.
The property is legally described as:
'The West 10 rods of the Northeast Quarter (NW '/4) of the Northeast Quarter (NE ' /A);
All that part of the North one half of the Northwest Quarter (NW '/4), Section 36,
Township 29, Range 21; All that part of the South one half of the Northwest Quarter
(NW 1/4) of the Southwest Quarter (SW ' /a) of the Northeast Quarter (NE 1/4), all in
Section 36, Township 29, Range 21, lying Northerly of the proposed Interstate
Highway No. 94, County of Washington, State of Minnesota, except Tract No. 1
and Tract No. 3.
WHEREAS, the Application was reviewed and recommended for approval by the Planning
Commission at a public hearing on November 23, 1998.
WHEREAS, the Application, the recommendations of the Planning Commission, and the
recommendations of the Staff were reviewed and the Application was approved by the City Council on
December 1, 1998.
NOW, THEREFORE, the City Council makes the following Findings:
1. The Conditional Use Permit is consistent with the standards for Conditional Use Permits specified
by Section 300.06, Subd. 4A. of the City Code.
FURTHER, BE IT RESOLVED, that a Conditional Use Permit is issued to Linda Kuester for a state
licensed day care and Ieaming center subject to the following conditions:
I . The Conditional Use Permit is issued to Linda Kuester, and is not transferable as to person or
location without City approval.
2. The Conditional Use Permit shall be reviewed annually consistent with City procedures for annual
Conditional Use Permit reviews.
3. The Conditional Use Permit shall remain valid only while the use and facility remains licensed for
day care by the State of Minnesota. Revocation of State licensing shall constitute automatic
revocation of the Conditional Use Permit without further notice, hearings or process.
4. Compliance with all other applicable City Code provisions.
APPROVED by the Lake Elmo City Council on the V day of December, 1998.
