CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 99 -63 <br />A RESOLUTION DENYING A CONDITIONAL USE PERMIT <br />FOR NON - RESIDENTIAL USE <br />IN THE FIELDS OF ST. CROIX <br />WHEREAS, the Lake Elmo Planning Commission considered...a request by. Robert Engstrom,. the <br />developer of the Fields of St. Croix, for a Conditional Use Permit for non - residential use in an OP Project <br />adjacent to Highway S; <br />WHEREAS, the Lake Elmo Planning Commission at its September 20, 1999 meeting reviewed <br />and recommended denial of a Conditional Use Permit for non - residential use as proposed by Robert <br />Engstrom based on the following findings: <br />1. inconsistency with recommended Old Village policy regarding commercial development. <br />2. Not compliant with the Comprehensive Plan. <br />WHEREAS, the Lake Elmo City Council considered the request by Robert Engstrom <br />for a Conditional Use Permit for non - residential use in the Fields of St. Croix — Phase 11; <br />THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council does hereby <br />deny the request by Robert Engstrom for a Conditional Use Permit based upon: <br />1. The Planning Commission Findings at its September 1.3, 1999 meeting. <br />2. The Conditional Use Permit is not in compliance with the standards for Conditional Use <br />Permits prescribed by Section 300.06 of the Lake Elmo City Code. <br />ADOPTED, by the Lake Elmo City Council on September 21, 1999. <br />Lee Hunt, Mayor <br />ATTEST: <br />Mary'l, of , City A 'nistrator <br />
