Resolution No. 99-68
A RESOLUTION VACATING EXISTING PLATTED
DRAINAGE AND UTILITY EASEMENTS
ALONG BLOCK 1, LOTS 13/14 AND BLOCK 1, LOTS 12/13
IN THE HOMESTEAD
WHEREAS, at the September 7, 1999 meeting of the Lake Elmo City Council,
Washington County, Minnesota, the Council granted a minor subdivision to Paul DeWitt,
The Homestead OP; and
WHEREAS, the Minor Subdivision was granted subject to the condition of
vacation of the existing platted drainage and utility easements along the property lines
between Block 1, Lots 13/14 and Lots 12/13; and
WHEREAS, at a Public Hearing on October 5, 1999, the City Council considered
the interest of the public in the vacation of the utility easements; and
NOW, THEREFORE, BE IT RESOLVED that vacation of existing platted
drainage and utility easements along Block 1, Lots 13/14 and Block 1, Lots 12/13 in the
Homestead OP Plat is hereby vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice of
Completion of these proceedings which shall contain the name of the City, and the
identification of the vacation, a statement of the time of completion thereof, and a
description of the land affected thereby. Such Notice shall be presented to the
Washington County Auditor who shall enter the same in his transfer records and note
upon the instrument over his official signature the words "entered in the transfer records."
The Notice shall then be filed with the County Recorder, all as required by Minnesota
Statutes.
ADOPTED by the Lake Elmo City Council this 501 day of October, 1999.

west of the following described line:
Commencing at the southwest corner of said Lot 13, thence North 89 degrees, 57 minutes, 48 seconds East,
assumed bearing along the south line thereof 110.57 feet to the point of beginning of the line to be
described; thence on a bearing of North 171.72 feet to the north line of said Lot 13, and said line there
terminating. Subject to easements.
Lot 12, Black 1, The Homestead. Washington County, Minnesota, and that part of Lot 13, said Block 1, lying
east of the following described line:
Commencing at the southwest comer of said Lot 13, thence North 89 degrees. 87 minutes, 48 seconds East,
assumed bearing along the south line thereof 110.57 feet to the point of beginning of the line to be
described; thence on a bearing of North 171.72 feet to the north line of said Lot 13 and said line there
terminating. Subject to easements.
Vacate the easements along the side lot lines of Lots 12 and 13 and of Lots 13 and 14.
