CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 99- 86 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR <br />GERALDINE BREHELM, BREHEIM KENNELS <br />WHEREAS, the Lake Elmo Planning Commission, at a Public Hearing on November 22, 1999, <br />reviewed and recommended approval of an amendment to the Conditional Use Permit to remove the 400 <br />foot setback provision based upon the following findings: <br />The physical circumstances of the site and the surrounding neighborhood have <br />not changed in a manner that obviates the original Findings in support of <br />Conditional Use Permit approval, and subsequent review and renewal over 27 <br />years. <br />A Conditional Use condition requiring a 400 -foot kennel setback was not a part <br />of the original Conditional Use Permit. There is no evidence of City Record to <br />indicate changes in the site or operations that would have dictated the need to add <br />the setback condition after - the -fact. <br />WHEREAS, the Lake Elmo Planning Commission recommended approval of the Conditional <br />Use Permit including the following conditions: <br />1. There be no more that seven (7) Shetland Sheep Dogs (a/k/a toy collie) over six <br />Months of age. <br />2. The Conditional Use Permit is not transferable. <br />3. If a nuisance should occur, a Public Hearing may be held to review the <br />Conditional Use Permit. <br />NOW, THERFORE, BE IT RESOLVED, that the Lake Elmo City Council does hereby <br />approve the Conditional Use Permit for Breheim Kennels. <br />ADOPTED by the Lake Elmo City Council this Th day of December, 1999. <br />Lee Hunt, MAYOR <br />ATTEST: <br />Maq ueffll r, CITY INISTRATOR <br />
