CITY OF LADE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 99- 45 <br />A RESOLUTION GRANTING A MINOR SUBDIVISION TO <br />MARTIN F. COLON, MFC PROPERTIES CORPORATION <br />WHEREAS, Martin F. Colon, MFC Properties Corporation, has made application to the City of <br />Lake Elmo for a minor subdivision to Section 400.07 of the Lake Elmo Municipal Code of the following <br />described parcel of land; to wit: <br />The Northeast Quarter of the Southeast Quarter and the East Half of the Southeast Quarter of the Southeast <br />Quarter of Section 34, Township 29, Range 21, Washington County, Minnesota, except that part thereof <br />embraced within Washington County Highway Right of Way Plat No. 48 -19B and Minnesota Department <br />of Transportation Right of Way Plat Numbered 82 -43, according to the recorded plats thereof. Subject to <br />right of access acquired by the State of Minnesota per Final Certificate filed as Document No. 613150. <br />Subject to a Northern States Power Company easement as described in Book 277 of Deeds, page 553. <br />WHEREAS, the Lake Elmo Planning Commission considered this minor subdivision request at <br />its July 12, 1999 meeting and recommended that the minor subdivision be granted based on the following <br />findings: <br />1. The proposed Minor Subdivision is in compliance with the provisions of <br />Chapter 400 regarding Minor Subdivisions; and the intent of the Comprehensive <br />Plan (Land Use Element) with regard to compliance with zoning district standards. <br />NOW, THEREFORE, BE IT RESOLVED THAT a minor subdivision is hereby granted, by the <br />City Council to Martin F. Colon, MFC Properties Corporation, resulting in the following described parcels: <br />PARCEL A: <br />That part of the Northeast Quarter of the Southeast Quarter and the East Half of the Southeast Quarter of <br />the Southeast Quarter of Section 34, Township 29, Range 21, Washington County, Minnesota, lying <br />westerly of that part thereof embraced within Washington County Highway Right of Way Plat No. 48 -19B <br />and lying northerly of Minnesota Department of Transportation Right of Way Plat Numbered 82 -43, <br />according to the recorded plats thereof, containing 1,960,374 square fee/45.00399 acres, subject to a <br />Northern States Power Company easement as described in Book 277 of Deeds, page 553. <br />PARCEL B: <br />That part of the East Half of the Southeast Quarter of the Southeast Quarter of Section 34, Township 29, <br />Range 21, Washington County, Minnesota, described as follows: Beginning at a point on the west line of <br />said East Half of the Southeast Quarter of the Southeast Quarter of Section 34 distant 117.99 feet north of <br />the southwest corner thereof, said point also being in the boundary of Parcel 33, Minnesota Department of <br />Transportation Right of Way Plat Numbered 82 -43, according to the recorded plats thereof; thence North 0 <br />degrees 50 minutes 36 seconds West, assumed basis for bearings, along said west line 286.11 feet to said <br />Parcel 33 boundary; thence North 38 degrees 02 minutes 20 seconds East, along said boundary, 321.21 <br />feet; thence northeasterly, along said boundary, on a tangential curve concave to the southeast, central <br />angle 39 degrees 48 minutes 22 seconds and radius 448.22 feet, 311.40 feet; thence South 48 degrees 21 <br />minutes 21 seconds East, along said boundary, 135.19 feet; thence South 0 degrees 53 minutes 15 seconds <br />East, along said boundary, 308.81 feet; thence South 34 degrees 19 minutes 59 seconds West, along said <br />boundary, 163.40 feet; thence South 69 degrees 32 minutes 54 seconds West, along said boundary, 314.92 <br />feet; thence southwesterly, along said boundary, on a tangential curve concave to the northwest, central <br />angle 3 degrees 44 minutes 14 seconds and radius 2764.79 feet, 180.34 feet to the point of beginning. <br />Containing 255,786 square feet/5.87204 acres, subject to right of access acquired by the State of Minnesota <br />per Final Certificate field as Document No. 613150. <br />
