RESOLUTION NO. 99- 45
A RESOLUTION GRANTING A MINOR SUBDIVISION TO
MARTIN F. COLON, MFC PROPERTIES CORPORATION
WHEREAS, Martin F. Colon, MFC Properties Corporation, has made application to the City of
Lake Elmo for a minor subdivision to Section 400.07 of the Lake Elmo Municipal Code of the following
described parcel of land; to wit:
The Northeast Quarter of the Southeast Quarter and the East Half of the Southeast Quarter of the Southeast
Quarter of Section 34, Township 29, Range 21, Washington County, Minnesota, except that part thereof
embraced within Washington County Highway Right of Way Plat No. 48 -19B and Minnesota Department
of Transportation Right of Way Plat Numbered 82 -43, according to the recorded plats thereof. Subject to
right of access acquired by the State of Minnesota per Final Certificate filed as Document No. 613150.
Subject to a Northern States Power Company easement as described in Book 277 of Deeds, page 553.
WHEREAS, the Lake Elmo Planning Commission considered this minor subdivision request at
its July 12, 1999 meeting and recommended that the minor subdivision be granted based on the following
findings:
1. The proposed Minor Subdivision is in compliance with the provisions of
Chapter 400 regarding Minor Subdivisions; and the intent of the Comprehensive
Plan (Land Use Element) with regard to compliance with zoning district standards.
NOW, THEREFORE, BE IT RESOLVED THAT a minor subdivision is hereby granted, by the
City Council to Martin F. Colon, MFC Properties Corporation, resulting in the following described parcels:
PARCEL A:
That part of the Northeast Quarter of the Southeast Quarter and the East Half of the Southeast Quarter of
the Southeast Quarter of Section 34, Township 29, Range 21, Washington County, Minnesota, lying
westerly of that part thereof embraced within Washington County Highway Right of Way Plat No. 48 -19B
and lying northerly of Minnesota Department of Transportation Right of Way Plat Numbered 82 -43,
according to the recorded plats thereof, containing 1,960,374 square fee/45.00399 acres, subject to a
Northern States Power Company easement as described in Book 277 of Deeds, page 553.
PARCEL B:
That part of the East Half of the Southeast Quarter of the Southeast Quarter of Section 34, Township 29,
Range 21, Washington County, Minnesota, described as follows: Beginning at a point on the west line of
said East Half of the Southeast Quarter of the Southeast Quarter of Section 34 distant 117.99 feet north of
the southwest corner thereof, said point also being in the boundary of Parcel 33, Minnesota Department of
Transportation Right of Way Plat Numbered 82 -43, according to the recorded plats thereof; thence North 0
degrees 50 minutes 36 seconds West, assumed basis for bearings, along said west line 286.11 feet to said
Parcel 33 boundary; thence North 38 degrees 02 minutes 20 seconds East, along said boundary, 321.21
feet; thence northeasterly, along said boundary, on a tangential curve concave to the southeast, central
angle 39 degrees 48 minutes 22 seconds and radius 448.22 feet, 311.40 feet; thence South 48 degrees 21
minutes 21 seconds East, along said boundary, 135.19 feet; thence South 0 degrees 53 minutes 15 seconds
East, along said boundary, 308.81 feet; thence South 34 degrees 19 minutes 59 seconds West, along said
boundary, 163.40 feet; thence South 69 degrees 32 minutes 54 seconds West, along said boundary, 314.92
feet; thence southwesterly, along said boundary, on a tangential curve concave to the northwest, central
angle 3 degrees 44 minutes 14 seconds and radius 2764.79 feet, 180.34 feet to the point of beginning.
Containing 255,786 square feet/5.87204 acres, subject to right of access acquired by the State of Minnesota
per Final Certificate field as Document No. 613150.
