RESOLUTION NO. 99 -28
A RESOLUTION SETTING CONDITIONS PRIOR TO RELEASE AND
RECORDING OF THE WATERS BAY FINAL PLAT
WHEREAS, the City Council approved the Final Plat of the Waters Bay
subdivision by resolution No. 99 -27 on April 20, 1999,
WHEREAS, said approval was subject to conditions to be satisfied prior to
release and recording of Final Plat documents by the City;
NOW, THEREFORE, BE IT RESOLVED, that the Final Plat mylars and
certified copy of Resolution No. 99- 27 shall be released by the City- to the developer
only upon compliance with the following conditions:
1. Payment of Park. Dedication Fees in accordance with Section 400 of the
City Code in the amount of $1,500.
2. Compliance with applicable requirements of the City Engineer's Review
Letter of February 4, 1999,
3. Submission of an easement for driveway access to Lot 1 specifying that
said access serve both Lots 1 and 2 at the point of intersection with Labe
Jane Trail; as illustrated in EXHIBIT A, signed by the City Planner on
April 20, 1999; subject to landscape planting of (6) six foot spruce and (6)
two foot spruce at the south driveway for maximum shielding.
4. Transfer of outlots to the adjoining property owners are to be completed
and recorded prior to issuance of any building permits by the City.
ADOPTED, by the Lake Elmo City Council this 20"' day of April, 1999,
