A RESOLUTION DENYING A VARIANCE FROM SECTION 300.07 4A 6
NON-AGRICULTURAL LOW IMPACT USE STANDARDS TO
E & E PROPERTIES, LCC
WHEREAS, Terry Emerson, E & E Properties, LCC, 11980 10`1i Street North, Lake Elmo,
Minnesota, has applied for a variance to the Standards of Section 300.07 4A 6 of the Municipal
Code;
WHEREAS, the variance requested by the applicant is for open. storage of mobile
equipment in excess of 26,000 pounds tare weight, where the Code requirement is less than 26,000
pounds tare weight;
WHEREAS, at its December 11, 2000 meeting, that the Planning Commission has held the
Public Hearing required by Code;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission denies all
elements of the variance application based on the following findings:
L The applicant has not demonstrated a hardship beyond that which is "self-imposed."
2. The applicant has not demonstrated a hardship beyond that which is economic in nature.
