RESOLUTION NO. 2001-021
F��-1U4 SOLUTION GRANTNG A VARIANCE TO SECTION 400.14, SUBD. SM
FOR LAKE ELMO VISTA
WHEREAS, Thomas Steffens, Metro Development Corporation, and Stephen Korhel have
applied for a variance to Section 400.14, Subd. 8M of the Lake Elmo Municipal Code to permit a street
right -of -way width of 48.91 feet along the north street frontage of Lot 1, Bock 1, Lake Elmo Vista.
WHEREAS, at its March 26th meeting, the Planning Commission recommended approval of the
variance requested based on compliance with the Findings required.
WHEREAS, at its April 3 d meeting, the City Council reviewed the variance requested by
Thomas Steffens and Stephen Korhel.
NOW, THEREFORE, BE IT RESOLVED, that the City Council approves a variance to Section
400.14 Subd. 8M of the City Code to permit a street right -of -way width of 48.91 feet along the North
street frontage of Lot 1, Block 1, Lake Elmo Vista based on the following Findings:
1. A strict application of the street right -of -way width standard would deprive the applicant
reasonable use of this land.
2. The variance will not be detrimental to the public health, safety and welfare.
3. The variance application is the result of an unusual hardship related to the physical
characteristics of this land related to an inaccurate calculation of the distance required to
accommodate a street right -of -way at this location by a prior Minor Subdivision.
ADOPTED, by the Lake Elmo City Council on the 3rd day of April, 2001
