Resolution 2002 -108
Whereas, the City Council of the City of Lake Elmo, following multiple local Public
Hearings, and a unanimous recommendation of the Planning Commission adopted a 2000
2020 Comprehensive Plan, as required by State Statute; and,
Whereas, said Plan adoption is subject to the review and comment of the
Metropolitan Council; and,
Whereas, the Metropolitan Council adopted Resolution 2002 -30 on September 11,
2002 that finds the Lake Elmo Comprehensive Plan "substantially departs from and has a
substantial impact on Metropolitan System Plans and therefore must be modified"; and,
Whereas, the Plan modifications mandated by Metropolitan Council Resolution.
2002 -30 would result in a fixture development strategy for the City that is significantly
different than that which would result from the Comprehensive Plan developed by Lake
Elmo, and adopted by Lake Elmo's elected City Council; and,
Whereas, those significant differences between the Metropolitan Council - mandated
Plan modifications and the adopted Lake Elmo Comprehensive Plan go to the very fabric of
future Lake Elmo community character, and represents an effort by the Metropolitan
Council to overturn the decisions of local elected officials regarding that community
character; and,
Whereas, the Metropolitan Council in its decision regarding the Lake Elmo
Comprehensive Plan has extended its reach and authority regarding Regional Systems well
beyond the bounds intended by the Minnesota Legislature, and;
Whereas, should the decision of the Metropolitan Council regarding the Lake Elmo
Comprehensive Plan stand, local decisions by elected officials regarding development, land
use, and zoning policy that may not correspond with Metropolitan Council policy, whether
said Policy directly relates to Regional Systems protection or not, will be subject to
Metropolitan Council veto, and;
Whereas, the impact of the Metropolitan Council's decision regarding the Lake Elmo
Comprehensive Plan will potentially extend to issues of self determination for each and
every unit of government within the 7- County Metropolitan Area.
Now therefore be it resolved by the City Council of the City of Lake Elmo that it should and
hereby does authorize and direct the Mayor and City Administrator as follows:
1. To provide a copy of this Resolution to every unit of local government within the 7-
County Metropolitan Area.
2. To accompany a copy of the Resolution with a letter from the Lake Elmo Mayor
requesting local units of government to carefully consider the potential consequences
for the self determination of their unit of government in the context of the
Metropolitan Council decision of the Lake Elmo Comprehensive Plan.
3. To include in the cover letter froin the Mayor an admonition to other elected local
government officials a request that they ask Legislative candidates for their areas
their positions regarding the powers of the Metropolitan Council in relation to those
of local government in the 7 County Area — particularly with respect to land use and
zoning.
