RESOLUTION NO. 2002-085
A RESOLUTION GRANTING AUTHORIZATION TO ISSUE ESCROW
REFUNDS PRIOR TO COUNCIL ADOPTION OF CLAIMS
WHEREAS, the Lake Elmo City Code requires a builder to deposit a $1,000
escrow deposit for driveway /erosion control for new construction and remodeling
projects.
WHEREAS, when the City completes the final inspection of streets, grading and
vegetation, a check is processed for payment back to the builder.
NOW, THEREFORE, BE IT RESOLVED, in an effort to reduce the delay and
minimize builder and resident frustration, the Finance Director is hereby authorized to
refund escrow payments, not to exceed $5,000.00, after completion of final inspection
and signoffby the Building Official.
FURTHERMORE, the escrow refunds will be reported as claims at the Council
meeting immediately following their issuance.
ADOPTED, by the Lake Elmo City Council on the 3rd day of September, 2002.
