CITE' OF LAKE ELMO <br />WASHINGTON COUNT', MINNESOTA <br />RESOLUTION NO. 2002-073 <br />A RESOLUTION AMENDING RESOLUTION N0. 88 -5 GRANTING A <br />CONDITIONAL USE PERMIT <br />TO THE OAKDALE GUN CLUB FOR AN OUTDOOR TARGET RANGE <br />IN THE AGRICULTURAL ZONING DISTRICT <br />WHEREAS, by Resolution No. 88 -5, the Oakdale Gun Club received approval <br />for a Conditional Use Permit to operate an Outdoor Target Range located at 10386 N. <br />I 01 Street. <br />WHEREAS, by Resolution No. 95 -58, the Oakdale Gun Club received approval. <br />for an amendment to allow construction of a caretaker residence and storage building, <br />WHEREAS, the Oakdale Gun Club has applied for an amendment to the existing <br />Conditional Use Permit, <br />WHEREAS, the applicant has submitted all the required documentation and fees <br />for the application of such expansion of use for the existing Conditional Use Permit; and <br />WHEREAS, the Lake Elmo Planning Commission held a public hearing on July <br />22, 2002 on the application for an amendment to the Conditional Use Permit to allow <br />construction of a 50 foot by 62 foot noise abatement shelter over the 25 yard range, based <br />on plans staff -dated July 18, 2002; and recommended approval of the Conditional Use <br />Permit amendment based on the following findings: <br />1. The proposed CUP amendment will not result in additional impact on the <br />public health, safety, morals or general welfare of surrounding property. <br />Operations of the gun club will not be altered as a result of the CUP <br />amendment. The impact of the existing operations resulting in noise will be. <br />reduced as a result of the CUP Amendment. <br />2. Traffic impacts of the use will not change as a result of the CUP amendment. <br />3. Effect on public utilities and school capacity are not applicable. <br />4. There will be no changes in visual impact of the use, but adjoining properties <br />will benefit from the amendment by reduction of noise levels generated by the <br />use. <br />5. The amendment does not have an impact on the Comprehensive Plan. <br />
