A RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
FOR A GOLF PRACTICE FACILITY TO
HIKER DEVELOPMENT
WHEREAS, Hiner Development, Inc. has made application to the City of Lake
Ehaio for a Conditional Use Permit allowing a Golf Practice Facility as a commercial
recreation use in the AG Zoning District based on plans staff dated January 23, 2002, at a
parcel of land legally described as:
That part of the Northeast Quarter of the Southeast Quarter of Section 34,
Township 29, Range 21, Washington County, Minnesota, lying westerly of
Washington County Highway Right of Way Plat No. 48-19B.
WHEREAS, the Lake Elmo Planning Commission considered this Conditional Use
Permit request at its January 28, 2002 meeting, and recommended that the Conditional Use
Permit be granted.
NOW, THEREFORE, BE IT RESOLVED that a Conditional Use Permit is
hereby granted by the City Council to Hiner Development, Inc., and,
BE IT FURTHER RESOLVED, that this Conditional Use Permit is granted
subject to the following conditions:
1. Elimination of the "mini-golf" use based on use characteristics
unrelated to the primacy golf practice facility use.
2. Limitation to the scale of the food service and golf pro shop
accessory uses to that represented by the applicant's floor plans
dated by Staff January 23, 2002.
3. All buildings, signage, and parking areas shall be subject to review
and approval by the City of a formal Section 520 Site Plan.
Commercial zoning district performance standards shall apply to
those improvements.
4. Any structure with a gross floor area exceeding 5,000 square feet
shall have fire suppression sprinklers installed.
5. Extefior lighting of the golf practice facility shall be prohibited
unless the Conditional 'Use Permit is specifically amended to
include that feature.
d. Compliance with the review recommendations of the City
Engineer.
ADOPTED by the Lake Eh-no City Council this 5 "' day of February, 2002.
