RESOLUTION NO. 2003-058
A RESOLUTION AUTHORIZING THE RELEASE OF OBLIGATION TO CONVEY
PARK LAND TO THE CITY
WHEREAS, by a declaration of Cemetery dated August 1, 1973 and filed
September 4, 1973 in Book 323 of Deeds, page 310 as Document No. 315051 Richard J.
Lambert and Barbara Lambert dedicated certain land in Lake Elmo for a pet cemetery to
be known as Meadow Cemetery,
WHEREAS, the land is located generally in a strip of land about 400 feet wide
along the south side of STH NO. 212 in the Northwest Quarter of the Southeast Quarter
of Section 16, Township 29, Range 21 in Washington County, Minnesota,
WHEREAS, the Declaration contains the following paragraph: That the grantors
at such time as the cemetery no longer has any space for pet burials or at such time as it
ceases to be used as a pet cemetery shall convey the above described parcel to the City of
Lake Elmo for public use as a public recreational park.
WHEREAS, the City of Lake Elmo has no use for and is not interested in owning
a park on the Meadow Cemetery land.
NOW, THEREFORE, the City of Lake Elmo hereby rejects any offer to convey
the Meadow Cemetery land to the City and releases the present or future owners of said
land from any promise or obligation to convey said land to the City in the future.
BE IT HEREBY RESOLVED, that the Mayor and City Administrator are hereby
authorized to execute the Release of Obligation to Convey Park flan, which was created
in 1973 by that Declaration of Cemetery filed as Document No. 315051 regarding land
located generally in a strip of land about 400 feet wide along the south side of STH NO.
212 in the Northwest Quarter of the Southwest Quarter of Section 16, Township 29,
Range 21 in Washington County, Minnesota
ADOPTED by the Lake Elmo City Council on the I" day of July, 2003.
