HomeMy WebLinkAboutResolution 2003-068CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2003-068 A RESOLUTION APPROVING AN AFTER -THE -FACT APPLICATION TO MOVE A STRUCTURE INTO THE CITY WHEREAS, Jerome and Tracy Pierre moved a 624 square foot garage structure to their home site at 5665 Hytrail Avenue without the benefit of prior approval of the City; WHEREAS, at its July 28, 2003 meeting, the Planning Commission held a public hearing and adopted a recommendation to approve an after -the fact application by Jerome and Tracy Pierre to move the structure onto their 5665 Hytrail Avenue subject to the following condition: Re- siding of the garage by the applicants within 90 days to match the principal structure. 2. Provision to the City of financial security, in an amount specified by the Building Official, to insure completion of the siding project within the specified time frame. 3. Payment by the applicant of an application fee in an amount double that required by the City Fee Schedule for moving an accessory structure into the City as penalty for proceeding without the permit. WHEREAS, at its August 5, 2003 meeting, the City Council reviewed the after - the -fact application by Jerome and Tracy Pierre to move into the City a 624 square foot structure to their tax lot at 5665 Hytrail Avenue, based on the recommendation by the Planning Commission; WHEREAS, pursuant to Section 300.13, Subd I., of the Lake Elmo Municipal Code, Jerome and Tracy Pierre, the property owners, have requested approval to place a detached garage structure in front of the primary structure at 5665 Hytrail Avenue; NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of Lake Elmo hereby grants permission for Terry and Tracy Pierre to move in a 624 square foot structure in accordance with plans, staff dated July 8, 2003. BE IT FURTHER RESOLVED, the City Council for the City of Lake Elmo approves placement of the detached garage structure closer to the front line than the principal structure at 5665 Hytrail Avenue; subject to the conditions stated by the Planning Commission.
