HomeMy WebLinkAboutResolution 2003-070CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2003 -070 A RESOLUTION AMENDING THE CONDITIONAL USE PERMIT OF COUNTRY SUN FARMS /BERGMANN WHEREAS, on January 5, 1988 the Lake Elmo City Council adopted Resolution No. 88-4 Granting a Conditional Use Permit to Richard and Eileen Bergmann, Country Sun Farm for Greenhouse and Sales Lot, at 11211 60`" Street North, in the Agricultural Zoning District; WHEREAS, Richard and Eileen Bergmann, Country Sun Farm, have made application to amend the existing Conditional Use Permit to add the sale of food as a subordinate use to the retails sales function; WHEREAS, at its August 11, 2003 meeting, the Planning Commission recommended approval of an amendment to the existing CUP for Country Sun Farms to add an incidental and subordinate use of the sale of carnival and snack foods and beverages subject to conditions: WHEREAS, at its August 19, 2003 meeting, the Lake Elmo City Council reviewed the application of Bergmann/Country Sun Farm to amend the existing Conditional Use Permit to add sales of food as a subordinate and incidental use; NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council approves amending the existing Country Sun Farm Conditional Use Permit to include the sale of foods and beverages as a subordinate and incidental use as recommended by the Planning Commission and subject to the following conditions. 1. Sales of food items shall be limited to snacks and carnival type foods /beverages. 2. Food sales shall be allowed only during the hours of operation of the retail store; and, only during the months of April, May, June, September, October, November, and December. 3. All food preparation and sales shall be conducted within an area of 625 square feet of the retail sales structure as depicted on the applicant's drawing staff dated August 11, 2003. Any relocation or enlargement of this food preparation and sales area shall only be considered upon application for a CUP amendment. 4. The applicant shall be responsible for posting and enforcing no parking on State Highway 36 Right -of- -Way during hours of business operation.
