WHEREAS, Richard J. and Eileen R. Bergmann have made application to the City
of Lake Elmo for a Minor Subdivision pursuant to Section 400.07 of the Lake Elmo
Municipal Code from the following three described parcels of land; to wit:
Document No. 452150, PID No. 01.029.21.23.0004
The East 695.22 feet of the Southwest Quarter of the Northwest Quarter
(SW 1/4 of NW 1/4) of Section One (1), Township Twenty -nine (29) North,
Range Twenty -one (21) West, City of Lake Elmo, Washington County,
Minnesota, Excepting therefrom the South 66.0 feet thereof. Containing
20.0 acres, more or less.

The East Half of the Northwest Quarter of the Northwest Quarter (E 1/2 of
NW 1/4 of NW 1/4) of Section One (1), Township Twenty Nine (29),
North of Range Twenty one (21) West. Containing 17.61 acres, more or less:
according to the plat thereof on file and of record in the office of the
Register of Deeds of Washington County, Minnesota,
Book 311 of Deeds, Page 310, PID No. 01.029.21.22.0005
The South 534.9 feet of the North 925.9 feet of the West one -half of the
NW 1/4 of NW 1/4 in Section No. 1, Township 29 North, Range 21 West,
being and containing 8.105 acres.
WHEREAS, the Lake Elmo Planning Commission considered this Minor
Subdivision request at its September 8, 2003 meeting, and recommended that the Minor
Subdivision be granted.
NOW, THEREFORE, BE IT RESOLVED that a Minor Subdivision is hereby
granted by the City Council to Richard J. and Eileen R. Bergmann resulting in the following
parcels:

LEGAL DESCRIPTION FOR PARCEL A
That part of the Northwest Quarter of the Northwest Quarter of Section 1, Township 29
North, Range 21 West, Washington County, Minnesota described as follows:
Commencing at the northwest corner of said Northwest Quarter of the Northwest
Quarter; thence South 00 degrees 42 minutes 37 seconds East, bearing oriented to the
Washington County Coordinate System NAD83, along the west line of said Northwest
Quarter of the Northwest Quarter a distance of 667.33 feet to the south line of the north
667.30 feet of said Northwest Quarter of the Northwest Quarter and the point of
beginning; thence continue South 00 degrees 42 minutes 37 seconds East along said west
line 258.61 feet to the south line of the north 925.90 feet of said Northwest Quarter of the
Northwest Quarter; thence North 89 degrees 47 minutes 33 seconds East along said south
line 347.82 feet; thence North 07 degrees 20 minutes 43 seconds East 138.04 feet; thence
North 43 degrees 50 minutes 47 seconds East 112.12 feet; thence North 00 degrees 12
minutes 27 seconds West 41.18 feet to said south line of the north 667.30 feet of the
Northwest Quarter of the Northwest Quarter; thence South 89 degrees 47 minutes 33
seconds West along said south line 446.20 feet to the point of beginning, containing 2.30
acres, more or less.
Subject to a highway easement along the westerly line thereof as described in Book 258
of Deeds, page 45, on file and of record in the office of the County Recorder, Washington
County, Minnesota.
Also, subject to a drainage easement in favor of Washington County as described in
Document No. 3002204, on file and of record in said office of the County Recorder.
Also, subject to a 225.00 foot wide transmission line easement in favor of Northern States
Power Company.

excepting therefrom the South 66.00 feet thereof
Also, the East Half of the Northwest Quarter of the Northwest Quarter of said Section 1.
Also the South 534.90 feet of the North 925.90 feet of the West Half of the Northwest
Quarter of the Northwest Quarter of said Section 1, except that part thereof described as
follows:
Commencing at the northwest corner of said Northwest Quarter of the Northwest
Quarter; thence South 00 degrees 42 minutes 37 seconds East, bearing oriented to the
Washington County Coordinate System NAD83, along the west line of said Northwest
Quarter of the Northwest Quarter a distance of 667.33 feet to the south line of the north

Washington County, Minnesota.
Also, subject to a highway easement along the most westerly line thereof as described in
Book 258 of Deeds, page 45, on file and of record in said office of the County Recorder.
Also, subject to a 225.00 foot wide transmission line easement in favor of Northern States
Power Company.
