CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2005- 026 <br />A RESOLUTON VACATING EXISTING PLATTED DRAINAGE AND <br />UTILITY EASEMENTS IN BROOKMAN 3RD ADDITION <br />WHEREAS, the Final Plat of Brookman 3`d Addition included the dedication of a <br />drainage and utility easement along the new property lines. <br />WHEREAS, at a Public Hearing on March 15, 2005, the City Council considered <br />the interest of the public in the vacation of the drainage and utility easements; and <br />NOW, THERFORE, BE IT RESOLVED, the vacation of drainage and utility <br />easements described as the 20 foot easement, the centerline of said easement being the <br />common line lying between Lot I & Lot 2, Block 3, BROOKMAN 3RD ADDITION, <br />according to the plat on file and of record in the office of the County Recorder, <br />Washington County, Minnesota, lying south of the 10 foot easement along the north line <br />of said BROOKMAN 3RD ADDITION, and lying north of the 10 foot easement along the <br />south line of said Lot I & Lot 2, Block 3, BROOKMAN 3RD ADDITION. <br />BE IT FURTHER RESOLVED that the Clerk shall prepare a Notice of <br />Completion of these proceedings, which shall contain the same of the City, and the <br />identification of the vacation, a statement of the time of completion thereof, and a <br />description of the land affected hereby. Such Notice shall be presented to the <br />Washington County Auditor who shall enter the same in his transferred records and not <br />upon the instrument over his official signature the words "entered in. the transfer records." <br />The Notice shall then be filed with the County Recorder, all as required by Minnesota <br />Statutes. <br />ADOPTED by the Lake Elmo City Council this I `1�ay of` ch. 2005. <br />Maydi <br />
