RESOLUTION NO. 2005- 026
A RESOLUTON VACATING EXISTING PLATTED DRAINAGE AND
UTILITY EASEMENTS IN BROOKMAN 3RD ADDITION
WHEREAS, the Final Plat of Brookman 3`d Addition included the dedication of a
drainage and utility easement along the new property lines.
WHEREAS, at a Public Hearing on March 15, 2005, the City Council considered
the interest of the public in the vacation of the drainage and utility easements; and
NOW, THERFORE, BE IT RESOLVED, the vacation of drainage and utility
easements described as the 20 foot easement, the centerline of said easement being the
common line lying between Lot I & Lot 2, Block 3, BROOKMAN 3RD ADDITION,
according to the plat on file and of record in the office of the County Recorder,
Washington County, Minnesota, lying south of the 10 foot easement along the north line
of said BROOKMAN 3RD ADDITION, and lying north of the 10 foot easement along the
south line of said Lot I & Lot 2, Block 3, BROOKMAN 3RD ADDITION.
BE IT FURTHER RESOLVED that the Clerk shall prepare a Notice of
Completion of these proceedings, which shall contain the same of the City, and the
identification of the vacation, a statement of the time of completion thereof, and a
description of the land affected hereby. Such Notice shall be presented to the
Washington County Auditor who shall enter the same in his transferred records and not
upon the instrument over his official signature the words "entered in. the transfer records."
The Notice shall then be filed with the County Recorder, all as required by Minnesota
Statutes.
