A RESOLUTION GRANTING
COMPREHENSIVE PLAN AMENDMENT
GUIDING LAND USE FROM RAD TO RED
TO D & T DEVELOPMENT
WHEREAS, D & T Development has made application to the City of Lake Elmo
for a Comprehensive Plan Amendment, amending the land use guiding from RAD to
RED for the following parcel of land; to wit:
Combined Parcel Legal Description
That part of Government Lot 2 and that part of the SW '/4 of the NW 1/4, Section
27, Township 29, Range 21, Washington County, Minnesota, which part lies
south and west of the following described line: Commencing at the East Quarter
corner of said Section 27; thence on a grid bearing of South 00 degrees 4'
04 seconds East, along the east line of said Section 27 a distance of
657.18 feet to the point of beginning of the line to be described; thence South 89
degrees 11 minutes 51 seconds West 2125.75 feet; thence South 00 degrees 42
minutes 41 seconds East 153.25 feet; thence South 89 degrees 1.1 minutes 51
seconds West 1113.73 .feet; thence North 34 degrees 41 minutes 56 seconds
West, 695.58 feet; thence North 00 degrees 42 minutes 41 seconds West, 466
feet; thence North 67 degrees 22 minutes 53 seconds West 1.450.82 feet; thence
North 00 degrees 33 minutes 40 seconds West 219.31 feet; thence South 89
degrees 11 minutes 48 seconds West 317.27 feet more or less to a point on. the
west line of said Section 27 distant 1029.01 feet north of the West Quarter corner
of said Section and there ending.
WHEREAS, the Lake Elmo Planning Commission considered this
Comprehensive Plan Amendment request at its December 13, 2004 meeting, and
recommended that the Comprehensive Plan Amendment be granted.
WHEREAS, the Comprehensive Plan Amendment request was presented to the
City Council at its January 4, 2005 City Council Meeting where the following Finding
was made:
The Comprehensive Plan Amendment proposed does reflect a change in
conditions related to the City zoning ordinance structure that impacts this site.
The reguiding of this site from RAD to RED is adequately supported and
warranted.
NOW, THEREFORE, BE IT RESOLVED that a Comprehensive Plan
Amendment is hereby granted by the City Council to D & T Development.
BE IT FURTHER RESOLVED, that this Comprehensive Plan Amendment is
granted subject to the following condition:
1. Subject to review by the Metropolitan Council.
