CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2007-084 <br />A RESOLUTION APPROVING LAKESHORE SEPTIC SYSTEM SETBACK VARIANCE TO <br />ALLOW A NEW SEPTIC SYSTEM AS REQUESTED BY FREDERICK L. PAUL AT 8186 <br />HILL TRAIL NORTH <br />WHEREAS, Frederick L. Paul has made application to the City of Lake Elmo for a 20- <br />foot variance from the 75-foot sewage treatment system setback from the ordinary high water <br />mark (OHW) at 8186 Hill Trail North, Lake Elmo, Minnesota. <br />WHEREAS, the Lake Elmo Planning Commission considered the variance request at its <br />October 22nd, 2007, meeting, and recommended that the variance be granted based on the <br />following Findings: <br />1. The requested variance is reasonable to provide wastewater management for the home <br />on the property. <br />2. The character of the City and neighborhood will not be impacted by the proposed <br />septic system. <br />3. The applicant was not responsible for the constraints on the property which prevents <br />placement of an on-site septic system which meets code requirements. <br />WHEREAS, the Lake Elmo City Council has reviewed the OHW septic system setback <br />variance requested by Frederick L. Paul, 8186 Hill Trail North at the November 5, 2007 meeting. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council hereby <br />approves the 20-foot variance from the 75-foot sewage treatment system setback from the <br />ordinary high water mark (01-1W) requested by Frederick L. Paul, 8186 Hill Trail North, based on <br />Findings of the November 5, 2007 Planning Staff Report and plans dated April 17, 2007 and, <br />BE IT FURTHER RESOLVED, that the approval of the requested variance shall include <br />the following conditions: <br />1. All. necessary pen-nits shall be provided to the City. <br />2. The applicant shall comply with any additional requirements established by the City <br />Engineer and City Attorney. <br />
