RESOLUTION NO. 2007- 083
RESOLUTION ADOPTING ASSESSMENT ROLL FOR CITY WATER CONNECTION SYSTEM
INTERCONNECT PROJECT PHASES I F± 11
WHEREAS, on September 2, 2006, the Lake Elmo City Council adopted
Resolution No. 97-176 which established Lateral Water Main Charges for the City's
Water Connection System Interconnect Project Phases I a If ("Project");
WHEREAS, on June 5, 2007, the Lake Elmo City Council adopted Resolution No.
2007-042 which provided that property owners who connected to the Project prior to
September 1, 2007 would have the right to elect to have the Lateral Water Main
Charges and Connection Charges specialty assessed against their property over five (5)
years at an interest rate of 5.75% per annum;
WHEREAS, the following property owners have signed Lateral Water Main
Benefit Charge and Connection Charge Repayment Agreements ("Agreements") which
have been approved by the Lake Elm City Council:

WHEREAS, the Agreements authorize the City of Lake Elmo to specialty assess
the Lateral Water Main Charges and Connection Charges against their respective
parcels pursuant to provisions of M.S. 444.075, Subd. 4.; and
WHEREAS, the City of Lake Elmo has completed all procedures necessary in
order to specialty assess the above parcels pursuant to M.S. 444.075, Subd. 4.
NOW, THEREFORE, BE IT RESOLVED:
1. The proposed Assessment Rott, a copy of which is attached hereto and
made a part hereof, is hereby accepted and shall constitute the Special
Assessments against the Tracts of land named therein, and each Tract of
land is hereby found to be specially benefited by the improvements
resulting from the construction of the Project in the amount of the
Special Assessment levied against it.
2. Such Special Assessment shalt be payable in equal annual principal
installments extending over a period of five (5) years. The first of the
installments is to be payable on or before the first Monday in January,
2008, and shall bear interest at the rate of 5.75% per annum from the
date of the adoption of this Special Assessment Resolution until
December 31, 2008. To each subsequent installment shall be added
interest for one (1) year on all unpaid installments, The City Clerk shalt
forthwith transmit a duplicate of this Assessment to the County Auditor
to be extended on the property tax list for the County. Such
Assessments shall be collected in the same manner as other municipal
taxes.
