RESOLUTION NO. 2007-055
A RESOLUTION DECLARING A NEGATIVE NEED FOR AN
ENVIRONMENTAL IMPACT STATEMENT FOR THE OLD VILLAGE
SANITARY SEWER EXTENSION
WHEREAS, the City of Lake Eli-no is the Regulatory Government Unit in
the preparation of the Environmental Assessment Worksheet (EAW) for the
proposed Old Village Sanitary Sewer Extension Project, which will be extending
trunk sanitary sewer and water main along 30th Street, from Reid Park to Lake
Elmo Avenue, and then south along Lake Elmo Avenue to 20th Street, including
a lift station to be installed at 20th Street with a forcemain pipe extending south to
a MCES interceptor sewer located at Hudson Boulevard; and
WHEREAS, the EAW is based on the construction of a new trunk sanitary
sewer and water main; and
WHEREAS the EAW analyzed the scenario for construction of the new
trunk sanitary sewer with the highest potential environmental impacts ("worst
case scenario") among the options that the City is considering-,
WHEREAS the City of Lake Elmo has submitted a copy of the EAW to all
public agencies on the EAW distribution list, publishing EAW availability in the
EQB Monitor on April 23, 2007, all of which were done in accordance with
applicable State laws, rules, and regulations; and
WHEREAS, the 30-day comment period ended on May 23, 2007, with five
regulatory agencies commenting; and
WHEREAS, the City of Lake Elmo acknowledges the comments from the
Metropolitan Council, the Minnesota Department of Natural Resources,
Washington County, the Minnesota Department of Transportation, and the Valley
Branch Watershed District; and
WHEREAS, the comments received do not Support a need for an
Environmental Impact Statement on the proposed project,- and
WHEREAS, the City of Lake Elmo has considered the comments that
were received and shall complete the Record of Decision supporting the
declaration of negative need, including responses to the commenting regulatory
agencies.

NOW, THEREFORE, he it resolved that the City Council of the City of
Lake Elmo has made a negative declaration on the need for an Environmental
Impact Statement for the Old Village Sanitary Sewer Extension.
