WHEREAS, the common boundary between the Cities of Lake Elmo and
Woodbury is the north right -of -way line of State Trunk Highway 12; and
WHEREAS, the portion of State Trunk Highway 12 which extends along the
common boundary between the Cities of Lake Elmo and Woodbury will be referred to
herein as the "Lake Elmo- Woodbury STH I2 Segment "; and
WHEREAS, the construction of I -94 caused all of the Lake Elmo- Woodbury STH
12 Segment and a strip of undevelopable land located southerly of the Lake Elmo -
Woodbury STH 12 Segment and northerly of the 1 -94 right -of -way to be isolated from
the City of Woodbury (Isolated Area); and
WHEREAS, the Minnesota Departinent of Transportation agreed to turn back the
Lake Elmo - Woodbury STH 12 Segment to the City of Lake Elmo (Exhibit A). Attached
and incorporated; and
WHEREAS, the Cities of Lake Elmo and Woodbury wish to redefine their
common boundaries; and
WHEREAS, The City of Lake Elmo wishes to annex and the City of Woodbury
wishes to detach the Isolated Area; and
WHEREAS, Minnesota Statute Chapter 414.061 provides for the concurrent
detachment and annexation of properties between two municipalities pursuant to the
procedures set forth in said statute; and
WHEREAS, a legal description of the land proposed to be detached and annexed
is described in Exhibit B attached and incorporated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lake Elmo,
Washington County, Minnesota as follows:
1. The City of Lake Elmo requests the Minnesota Office of Administrative
Hearings/Municipal Boundary Adjustments to approve the annexation of the
property described on Exl-iibit A, from the City of Woodbury and concurrently
annexed to the City of Lake Elmo.
2. That said concurrent detachment and aimexation would be in the best interests of
the City of Lake Elmo and the City of Woodbury.
3. That a copy of this resolution shall be forwarded to the Minnesota Office of
Administrative Hearings/Municipal Boundary Adjustments for review and
approval.
This Resolution was declared duly passed and adopted and was signed by the
Mayor and attested to by the City Administrator on this the 1 -1 of
2007.

EXHIBIT A
City of Lake Elmo Annexation Area
The annexation area shall include that portion of the City of Woodbury lying north of the
following described line: Commencing at the south quarter corner of Section 33, Township
29 North, Range 21 West; thence on an assumed azimuth of 0 degrees 13 minutes 58 seconds
along the north south quarter Iine of said Section 33 a distance of 63.04 feet to the northerly
boundary line of the City of Woodbury and the point of beginning of the line to be described;
thence easterly along the northerly boundary line of the City of Woodbury, on an azimuth of
89 degrees 20 minutes 05 seconds for 2198.24 feet; thence on an azimuth of 97 degrees 12
minutes 56 seconds for 65.86 feet; thence on an azimuth of 93 degrees 53 seconds 59 minutes
for 369.13 feet, to .a point on the east line of said Section 33, said point lies 36.80 feet
northerly of the southwest corner of Section 34, Township 29 North, Range 21 '',Jest; thence
continue on an azimuth of 93 degrees 53 seconds 59 minutes for 340.84 feet; thence on an
azimuth of 92 degrees 52 minutes 19 seconds for 251.62 feet to a point on the south line of
said Section 34, said point lies 591.59 feet easterly of the southwest corner of said Section 34;
thence continue on an azimuth of 92 degrees 52 minutes 19 seconds for 143.10; thence on an
azimuth of 90 degrees 52 minutes 04 seconds for 415.83 feet; thence on an azimuth of 89
degrees 20 minutes 33 seconds for 1477.11 feet to the south quarter corner of said Section 34;
thence on an azimuth of 89 degrees 54 minutes 07 seconds for 2651.20 feet to the southeast
corner of said Section 34; thence easterly along the south line of Section 35, Township 29
North, Range 21 West, on an azimuth of 89 degrees 53 minutes 56 seconds for 2632.23 feet to
the south quarter corner of said Section 35; thence continue easterly along the south line of
said Section 35 on an azimuth of 89 degrees 53 minutes 56 seconds for 2632.23 feet to the
southeast corner of said Section 35; thence easterly along the south line of Section 36,
Township 29 North, Range 21 West, on an azimuth of 89 degrees 53 minutes 15 seconds for
2643.18 feet to the south quarter corner of said Section 36; thence continue easterly along the
south line of said Section 36, on an azimuth of 89 degrees 53 minutes 15 seconds for 2643.18
feet to the southeast corner of said Section 36 and there terminating.
