CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2007-041 <br />A RESOLUTION APPROVING THE PLACEMENT OF A GARAGE STRUCTURE IN <br />FRONT OF THE PRIMARY STRUCTURE AT 8722 IRONWOOD TRAIL NORTH <br />WHEREAS, pursuant to Section 300.13, Subd.3C of the Lake Elmo Municipal <br />Code, Alan. Basel and Barb Helmer, the property owners, have requested approval to <br />place a 26 foot by 32 foot detached garage structure ten feet nearer the front property line <br />than the principal structure at 8722 Ironwood Trail North, in accordance with plans <br />received by staff May 24, 2007. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of <br />Lake Elmo hereby grants permission for construction of a 26 foot by 32 foot detached <br />garage structure ten feet nearer the front property line than the principal structure at 8722 <br />Ironwood Trail North, per plans received by staff dated May 24, 2007, subject to the <br />following conditions <br />1. The property line and right-of-way line for Ironwood Trail North must be located <br />and staked. A building permit shall. not be issued until the Building Official <br />verifies that the garage will be located 30 feet or more from the front property line <br />and not more than ten feet closer the front lot line than the primary structure as <br />identified on the submitted site plan dated May 24, 2007. <br />2. No trees or vegetation shall be removed within the 30 foot street set back area to <br />Ironwood Avenue North. <br />3. Prior to issuance of a building permit for the garage'structure, the property owner <br />shall submit a scaled drawing depicting the exact location of the proposed garage <br />structure in relation to the Ironwood Trail North right -of -way line and any other <br />structures on the site. The drawing shall also provide the location, approximate <br />size and types of foliage and trees existing within 30 feet of the proposed garage <br />structure, together with an indication of which trees and foliage will be removed <br />during garage construction. <br />ADOPTED, by the Lake Elmo City Council on the 5 ,b-4ay of, <br />Johnston, Mayor <br />ATTEST: <br />Susan Hoyt, City Administrator <br />
