RESOLUTION NO 2008-042 <br />CITY OF <br />WASHINGTON O & <br />WHEREAS, the Valley Branch Watershed District has requested a grading <br />permit to allow the movement of more than 400 cubic yards of material per acre of site <br />area at 4768 Larkspur Lane North, 4854 Linden. Trail North, 4910 Linden Trail North, <br />4886 Linden Trail North, and Outlot D of the Fields of St. Croix Subdivision in the R -R <br />zoning district (Open Space Preservation Development). <br />WHEREAS, the City Council held a Public Hearing on September 2, 2008; and <br />made the following findings: <br />• The project is intended to fix existing erosion issues through ravine restoration <br />and associated grading work to prevent sediment from washing into Goetsehel <br />Pond. <br />• There is a public benefit associated with the repair and the improvements of the <br />ravine. The work proposed at the project site will stabilize the slopes of the <br />creeks and improve water quality at Goetschel Pond. <br />• No work will occur on private property without a signed and recorded Temporary <br />Project Easement. <br />NOW, THERFORE, BE IT RESOLVED that the Lake Elmo City Council <br />hereby approves a grading permit at 4768 Larkspur Lane North, 4854 Linden Trail North, <br />4910 Linden Trail North, 4886 Linden Trail North, and Outlot D of the Fields of St. <br />Croix Subdivision; and, <br />DE IT FURTHER RESOLVED, that the approval of the requested grading <br />permit shall include the following conditions: <br />1) All Temporary Project Easements must be signed and recorded prior to issuing <br />the permit. <br />2) The City of Lake Elmo must be notified 48 hours prior to construction. <br />3) All work is to remain within Temporary Project Easements. <br />4) A copy of the construction schedule and notice of the schedule must be provided <br />to all neighborhood residents and the Lake Elmo City Hall, city engineer, and <br />public works department. <br />
