CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2008-039 <br />A RESOLUTION APPROVING A MOVING PERMIT TO ALLOW MARVIN <br />AND KAREN LEROL TO MOVE AN EXISTING ACCESSORY BUILDING TO <br />THEIR. PROPERTY AT 4150 IRISH COURT NORTH <br />WHEREAS, Marvin and Karen Lerol have requested a Moving Permit to allow <br />the movement of an existing accessory structure to their property at 4150 Irish Court <br />North in the R -1 zoning district. <br />WHEREAS, the Lake Elmo Planning Commission held a Public Hearing on <br />August 11, 2008, and unanimously recommended approval of the requested permit with <br />conditions; and, <br />WHEREAS, the City Council reviewed the request on August 19", 2008, and <br />made the following findings: <br />• The accessory building and the proposed location meets all applicable zoning <br />and building code requirements with the exception of the exterior, which the <br />applicant has agreed to alter. <br />• The applicant has agreed to paint the accessory building in order to match the <br />exterior of the primary structure or be of an earthen tone. <br />NOW, THERFORE, BE IT RESOLVED that the Lake Elmo City Council <br />hereby approves a Moving Permit to allow an accessory building to be moved to the <br />property at 4150 Irish Court North; and, <br />BE IT FURTHER RESOLVED, that the approval of the requested moving <br />permit shall include the following conditions: <br />1. Prior to the building being moved to the property, a building permit <br />application must be applied for and received from the city. <br />2. A security is required to be submitted in the amount of $ based <br />on a recommendation by the City Engineer and prior to the building being <br />moved to the property. The security is to cover all work necessary to <br />complete the project, restore existing infrastructure, site approvals, ensure <br />compliance of the structure and site to zoning and building code requirements, <br />and to paint the exterior of the building to conform to city code requirements. <br />
