CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2009-037 <br />WHEREAS, pursuant to Section 154.092 Subd. I of the Lake Elmo Municipal <br />Code, Ronald and Mary Ann Warner, the property owners, have requested approval to <br />place a new detached garage closer to the road right-of-way than the existing house and <br />attached garage by 26 feet at 4633 Birchbark Trail North, in accordance with plans <br />received by staff August 26, 2009. <br />WHEREAS, the location of the proposed detached garage is appropriate as it is <br />consistent with other detached garage setbacks in the neighborhood, is screened from the <br />road right-of-way, would avoid the removal of shoreland vegetation, and is in keeping <br />with the character of the neighborhood. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of <br />Lake Elmo hereby grants permission for construction of a new detached garage 185 feet <br />from the road right-of-way on the property at 4633 Birchbark Trail North. <br />ADOPTED, by the Lake Elmo City Council on the 1St day of September, 2009. <br />Johnston, Mayor <br />
