LAKE ELMO CITY COUNCIL MINUTES October 5, 2010 Special Meeting 1 <br />MINUTES APPROVED: October 19, 2010 <br />City of Lake Elmo <br />City Council Minutes <br /> <br />October 5, 2010 – Special Meeting <br /> <br />Mayor Johnston called the Special Meeting of the Lake Elmo City Council to order at <br />6:30 p.m. <br /> <br />PRESENT: Mayor Johnston and Council Members DeLapp, Emmons, Park and Smith <br /> <br />Also Present: Administrator Messelt, City Attorney Snyder, Attorney Baker and <br />Planning Director Klatt <br /> <br />City Attorney Synder explained the Agenda and purpose of the Special Meeting was to <br />meet in Executive Session pursuant to Minnesota State Statutes to discuss litigation <br />strategies relating to Bergmann et al versus the City of Lake Elmo et al. <br /> <br />APPROVAL OF AGENDA: <br /> <br />MOTION: Council Member DeLapp moved to approve the agenda of the October 5, <br />2010 City Council Special Meeting and to enter into Executive Session. Council Member <br />Smith seconded the motion. The motion passed 5-0. <br /> <br />DISCUSSION: Discussion ensued in Executive Session regarding current litigation <br />proceedings and litigation strategies relating to Bergmann et al versus the City of Lake <br />Elmo et al. <br /> <br />MOTION: Council Member Emmons moved to close the Executive Session. Council <br />Member Smith seconded the motion. The motion passed 5-0. <br /> <br />The Special Meeting and Executive Session of the Lake Elmo City Council ended at 7:03 <br />PM. <br /> <br />SUMMARY OF EXECUTIVE SESSION: Legal Counsel John Baker summarized the <br />proceedings of the Executive Session held at 6:30 PM regarding legal strategies relating <br />to Bergmann et al versus City of Lake Elmo et al. The City Council received an update <br />on the current status of legal proceedings and discussed legal strategies.
