Mayor Johnston called the council meeting to order at 7:00 p.m. in the council chambers.
PRESENT: Johnston, Conlin, DeLapp, Johnson, Smith, City Engineer Prew, City
Planner Dillerud, Finance Director Tom Bouthilet and Administrator Rafferty.
1. AGENDA
Regional Park comp plan 11A., Discuss how public gets involved and how council talks
to dev..procedures need to be developed. Council reports. M/S/P Johnson/smith - to approve the March 1, 2005 City Council agenda, as amended. (Motion passed 5-0).
2. MINUTES: February 15, 2005
M/S/P Johnson/Conlin - to approve the February 15, 2005 City Council minutes, as
amended. (Motion passed 5-0).

3. PUBLIC INQUIRIES/INFORMATIONAL:
A. Public Inquires
Wyn John, Friends of the Library, reported that at the February 28th meeting of the
Library Board, a motion to enter negotiations with the owner of the premises for leasing
space at 3479 Lake Elmo Avenue was unanimously approved. The aim is to compelte
these negotitaons by the next Library Board meeting on March 28. Library and Conty
staff are gathering data on faiity costs to convert the spae to a suitablelibrary locaitn. Whenthe upgrade csots are kow, the Librar Board Dircto is propsosing to approach the
Cit Council with a cost sharing request. As Secretary of the Friends of Lake Elmo
Library, Wy John asked that this requtest be treaed suympathetically by the Coucnil.y.
Add to cable meetings and book drive.
Paul Ryberg, Friend of the Library, reported they will host a book drive at 3585 Laverne
Avenue N., from 6 to 8 p.m. until March 19th. Items that can be used by the library will
be given to the library. A book sale will be held March 19, and leftover paperbacks will
be sent to military troops on active duty around the world. A silent auction may be held.
Mr. Ryberg asked if the Friends of the Library meetings can be televised.
B. Public Informational:
(1)Water Ski Show:Joe Kiesling
Joe Kiesling, Tri Lakes Association, requested Council approval of a Water Surface Use
Permit for the Annual Water Ski Show on Lake Jane, August 13, 2005. The Tri-Lakes Association has secured the appropriate insurance coverage and the Sheriff’s Department
will sign off on the permit pending Council approval. The Fire Department will provide
an emergency permit.
Mr. Kiesling explained he was asked by Sgt. Cusick to request a waiver from the Surfae Water Rules the Council
asked by cusick shoreland ordinance waived for the practices and
show…counterclockwise, run into sunset for a few minutes.
M/S/P DeLapp/ Johnson Motion passed 5-0.
M/S/P DeLapp/Johnson – to direct staff grant a temporary suspension of the rules for an
event of this to change the city ordinance to waive the shoreland restrictions and no
parking permit based on past favorable. (13 times) (Motion passed 5-0).
(2)St. Croix Valley Area Community Family Center:Doris Karls
update on needs. Continue discussion and planning around facility needs, further develop
integrated program plan, seed community feedback through focus groups and community
meetings, ire a project coordinator.
Encouraged the city to have a person on the guidance team. Small contribution for the project coordinator position.

Eric, Oak Park Heights city admin, service area would be confined to the Stillwater
school district.
The project is a community family center and not a ymca.
(3)Planning Commission Appointments M/S/P DeLapp/Johnson to reappoint Todd ptacek to a third term, vital as a rep south of
10th street and important to have good planning rep that are active in the process of
working with met council. Motion passed 5-0.
M/S/P Deb Lyzenga as the first alternate Johnson/DeLapp Motion passed 5-0.
M/S/P Julie Fliflet appoint as the second alternate, Smith/Conlin. (DeLapp the person
form stonegate would best serve the commission (motion passed 4-1Johnston).
4. CONSENT AGENDA:
A. Resolution No. 2005-019:Approving Claims
M/S/P to adopt Resolution No. 2005-019, approving claim numbers 243, 244,
DD350 through DD362, 26923 through 26954 which were used for staff payroll dated
February 17th, 2005 and claims 26955 through 26998 in the total amount of $337,401.25. (Motion passed 5-0).

A.Water Tower Storage Tank Design
Override from 60 to 80 wells in the aquifer. Areas have bad water in LJ water advisory,
south of hwy 5 and some contamination provide 31st street, Rafferty – investment is a
long term project, two potential locations based on making the system perform, determine by hydraulics geographic, and how well balanced liking well 1 and well 2.
Site that does not disturb existing trees, has been plowed since we owned it, building our
pubic works there, cold storage made the most sense. Future service. Rafferty pointed
out how the design of pw bldg did not disturb the area. Tonight deal with how the tower
fit on the site.
Designs were taken to the pw council committee. Johnston wasn’t legally requ9ired to
have a ph on this item, commitments have been made because we are along in the
process.
Ed Nielsen 9498 st , park committee, negotiated to purchase this park, with Dave
Morgan, commitments they made to the landowners and citizens. Submitted contracts
with owners of property along Sunfish Lake.
Lloyd Sherveim options to purchase for park purposes. Colopy, nipoldt, lehadt and francis fredridch, council wanted to get this land for it was developed. 2,000 an acre.
Was told he Layhard was selling his land tooo cheap so he could sell land 4,000 an acre.

Presented vision statement. Citizens bought it for a park. Water tower and pw is not
associated with a a park. Suggest Kelvin avenue by the rr tracks, simulate a barn,
Sue dunn got bond issue past by dave Morgan ed Nielsen, talked to Marty about colocatoing in park reserve with county public works. Don wiesnewski and
commissioner said they were not opposed to discussing this alternative that might not be
disruptive.
David Morgan buy land for recreational zoning, this may be a rezoning and should notify all the people affected, park land was once considered for a city hall and was told by legal
council that we have to use it for park purposes
Jim Blackford, proud of being a citizen of le, control development, spent their lives in public service to keep that dream alive. Argument with met council do to ourselves what we did not allow anyone else do to us. Basis of our argument would be gone. How can
we say no to others. Wrong place.
Olson father in law sold land to the city in 1974. knew layhards plan for piece of land. I was not planned for a water tower and pw bldg.
NIELSEN suggested the landfill area. DeLapp explained the reasons why it can’t be
used. Footings would cut into the protective sheet.
M/S/P Johnson/Conlin – to Table to consider input and look into legal ramifications. (Motion passed 5-0.)
Washington County runs the regional park reserve and the placed a pw bldg to address
their need. That facility came to the city for their review. Look into working together and the county is willing to work with you per Dunn. Don’t break covenants. Judy Blackford, notification of sites, father is Joseph Morris declined, 1974 was on parks
commission,
Jim Blackford suggested Ideal Avenue to build a tower which is high ground,
John Lalonde, owner of backyard, backs up to Sunfish Lake, doesn’t understand why you would think of placing water tower and bldg in the park. Wise idea of preserving a park
from the people that preceded you. Important decision and notifying didn’t seem the
proper position.

Smith/Johnson to take off the table. MOTION PASSED 5-0.

CONLIN asked about liability per filla, you don’t in this if you approve.
Johnson/conlin to draft a resolution for approval of the variance. Motion passed 5-0.

Dillerud asked for the Councils spin on what he provide, dean suggested comments be
in writing. DeLapp we got an agreement alls for 200 houses to be on sewer in 2010, 1500 by 2020, etc….we can chose to do this. If WE DON’T do this, with all the govt changeovers, have
to pt in 24000 people.
\the perspective is one to be considered. This is a discussion for the land use section Liz Johnson facility integrated with the office research uses, examples, does this
eliminate opportunities for some type of services to be a standalone. Dillerud pz only
wants to see this in the ov. Under House #3, support and adoption. If we want to
implement senior type that is adoption and not support. Dillerud developers take advantage of the wording such as adoption. You might support if it is good stuff. Under #4, what is medium and moderate income, certain guidelines we follow. Dillerud met co
has certain classifications of income and provided those classifications. Moderate means
6 0-80 in metro wide 7 counties. Page 7 forgetting to mention Cimarron. Question on
2/3 majority of the homeowners. Dillerud neighborhoods could get sewer service when they didn’t want it. They wanted the supermajority of the neighborhood to get the unities and be assessed for before the city would do it.
Johnston – referred to #1 question. Treated as a comp plan amendment wnd would need a
super majority to approve which means two people can stop it,..by two votes, Dillerud land changing hands by speculative ….Fillas the regulations do not belong in the policy section. Voting percentage belong as a regulation. Johnston Land use regs can overt urn
the supermajority that put the plan together. Filla the official controls control the
development in the city. Dillerud Have to zone 9 months afar you guide. Now you start
the speculative bubble. Dean mentioned a good reason the voting structure.. DeLapp met the met co requirements, getting very excessive; now we are adding up
things, do not want to accelerate growth. Need to do studies, Determine
How any want to sell house and move into high rises.
conlin asked to have this in a soft copy form and then have the staff merge all the suggestions.
Johnston naïve to say we would be better if we delay the project. Dillerud asked if we
could delay this discussion until we get to the land use plan. DeLapp asked what about the schools. Johnston said he talked to 834 school district.

Integrate comments and put them all in and who said what and where.
10. CITY ATTORNEY’S REPORT: 11. CITY ADMINISTRATOR’S REPORT:
regional park met with Jim Lugar and have not updated their comp plan in 25 years.
Very amenable to connect with trails, requested two reps to sit o this committee to the new comp plan. Sue Dunn expressed an interest to sit on this planning.
Rita said she would be interested and so would Margaret Carlson because park was
purchased with lawcon grants and used for park purposes.
Reserve status developing over 20 percent of what they are allowed to do about sue Dunn per DeLapp. Johnston said wait a week to see if teddie Carlson is interested and place on a council committee meeting..
12. CITY COUNCIL REPORTS:
DeLapp clean waster action suggested they send it to us to write Brian LeClair m asked them to write a resolution. Bring to a full group what went on in the past two weeks to bring up to the rest of the council. Was contacted by the church who worked for 3m TO
SEE IF he could get DeLapp to vote for the church. This is happening a lot and has more
and more since the met council asking to do more on the record. Expressed this as a
concern. Legally and ethically per Johnson. Rafferty Dillerud and himself have met with 3 or 4 developers. Never have had 3
members because of the local meeting law. Proper contact is meeting in this room.
Filla council adopts policy. Adopt similar code of ethics for the council. Let dev know what the rules are. Anne said what we do when we have no rules. Filla agree to abide by the rules. Rafferty said what we have done is very appropriate. Bring back policies.
Anne would like to see what some of the other cities do and present at the next council
committee meetings.
Liz Johnston,. stte4nded fire dept and liability issues, with Anne, what the fire dept deal with and good for working with fire dept in the future.
Thanked the applicants, congratulate deb and Julie per Anne Johnston volunteered to fill that role of the st Croix community family center wait until
the next council committee meeting built in a 3-5 year term, add to Finance because they
want financial support. Public Health.
