Mayor Johnston called the Council meeting to order at 7:00 p.m. in the Council chambers. PRESENT: Smith, Johnston, Johnson, DeLapp, City Engineer Prew, City
Attorney Filla, Building Official Jim McNamara, Public Works Supervisor Mike
Bouthilet. Finance Director Tom Bouthilet, City Planner Dillerud and Administrator
Rafferty. ABSENT: Council member Conlin
1. AGENDA: Delete: 8A. Add Joint Recreation Factility
Peter Bell is working on his response to our comp plan, make us have les housing
than Woodbury, DeLapp said we should deal with this as a county.Council Reports

(Motion passed 4-0). 3. PUBLIC INQUIRIES/INFORMATIONAL: Paul Ryberg, Friends of Lake Elmo Library, reported they used the Siedow house for
book sale and sent several hundred books to our troops in Iraq. Washington County is not
having a book drive at the Washington County Fair. Therefore, Mr. Rybert asked if the Friends of Lake Elmo Library could use the Siedow house for a book drive.
M/S/P DeLapp/Smithauthorizes continued use for a book sale for the wash cty sale.
(Motion passed 4-0.
4. CONSENT AGENDA: A. Resolution No. 2005-046:Approving Claims
M/S/P Johnson/smith to approve Claim Numbers 258, 259, DD419 through DD430,
27291 through 27319, which were used for staff payroll dated May 12, 2005; claims
27320 through 27372 in the amount of $83,720.57. (Motion passed 4-0).
5. FINANCE: A. Monthly Operating Report
May monthly operating report, note revenue contractors lices should be reversed, msxa
mainte4nance belongs in the infrastructure account $9000...CORRECTIONSW will be
made.
Gas and electric on an accelerated expenditures. Admin misc accounts were not taken
into account during the budget period.
Start the 2006 budget 6. NEW BUSINESS: A. Planning Commission Appointment
M/S/P DeLapp/Johnston to appoint bob van Zandt as second alternate to the pz. (Motion
passed 4-0)

7. MAINTENANCE/PARK/FIRE/BUILDING:
A.(1) Update on Building Department Activities:Jim McNamara
The Building Official reported there were three permits for residential and three new commercial permits for April, 2005.
(2) Building Codes:Fire Protection:Ordinance No. 97-157
This was precipidtaededent by the library, good move, and work with the state on the option to move ahead per Johnston. This will be good for our downtime, The library is
not4ed as an A3 bldg.
This ordinance is for older cities.
DeLapp this is fair. M/S/P Johnston/Johnson – to adopt ordinance 97-157 adoption if mn state4 bldg code
by ordinance and repeal of section 500.02-500.07 of the4e city code. (Motion passed 4-
0).
B. Update on Parks Dept.
(1) MnReLeaf Grant from the MN Dept. of Natural Resources:Kathy

Kathy Widin
Contact4ed her she that residents have had oak wilt in the past. Spend more time on it
and money from this releaf program would be helpful.
Majority of thee match would come from po. City would provide a match for her to sped time with po and outreach.
DeLapp support th4e submittal of the application that widing prepared Johnston. (Motion
passed 4-0).
Ceremonial tree planting lions on Thursday, morning, required by the tree city usa. 6th
grade class has been invite4d from le school. Planting by the batting cages. Prepare
hole, explain tree planting process, small picnic for the kids, everybody has been inited.
Get message out that they can plant blvd trees per DeLapp. Carriage station was not given any trees, if we plante4d tress , dig our trees if they needed. Bring to committee
make sure direction for widing per Marty. Work with the state to plant trees o
(2) Arbor Day Celebration:Mike Bouthilet and Kathy Widin (verbal)
(3) Seasonal Help
The Public Works Supervisor recommended the rehire of two returning part-time
seasonal employees: John Eder and Michael Wagner at $10.75/hour. All summer help is
budgeted and monitored to stay within budget.

8. CITY ENGINEER’ REPORT:

In his memo dated May 13, 2005, the City Engineer reported the developers of the Prairie
Ridge Office Park have requested the City extend water service to their site

What’s going to happen to the access to 36 per Dillerud. Reasonable flow to 36 and it
need not be a straight shot.
Tim freeman putmen, mick Lynsky Would like to have the city extend water to them. And be on a level playing field like all the other developers under construction.

Dillerud appreiddates ste4ves concerns. Prudent to anticipate the need to someday accomodate4 something like that. Connection e to w on this property. That street shown
should be more improved than shown. Does this alternative provides the same answer
bring traffic from one side of the pat to the other.
Dillerud said Steve ideas are good but are judgment calls. The pz discussed that bridge at length and thought it was a bit much, and he felt it was a bit much. Eagle point dealt with
bridges should be looked at. Street lights should not be there at all. See the mn land trust
to find out what they would accept or not. Condition #5 Steve has objected to it. Could
add steves memo to resolution as guidance. Freeman this dev is going way beyond what the ordinane requires. Unfair. Land trust
esement or we will not be approved. City had held easements. Problem with heaping
things on, nitpick with all the things we did on the plan.

Thanked Chuck per Smith came through with a fabujlous proposals and coming up with
the money

M/S/P approving an amended site plan for 11051 Stillwater Bvd. per plans staff
dated May6 Brick with cedar accidents, corrugated roofing
new site plan comply with archite4ctural guidelines.
DeLapp Is the sign grandfathered in…Dillerud as long as they don’t move the structure.
Add 5th condition Johnston/Johnson that roofing material not be corrugated.
Plan was not done by an architect but Meyer, has to have a registration stamp, plan stamping against state law.

D. Central Water and Sewer Service In OP Developments
Delapp suggest4ed having cindy weckworh from wash cty to come and tlk to us. Johnsto asked if there is a sense of urgecy.l facig op dev coming thru the door and have ord in palce,
Ask staff to get started and have cindy weckworth to come to the next meeting.
M/S/P Johnson/Smitgh - to direct staff to pursue ord to support recommendation and ask to get additional information from weckworth. (Motion passed 4-0).
E. Dupuis/Engstrom Minor Subdivision- Amended
M/S/P DElAPP/Johnson adopt RESolution 2005-050. (Motion passed 4-0).

Johnston its not the time to be talking about rattling sabers. If we don’t get 2.91 pproved
we will get 2.53. constitue our negation tam and go back to met co rather than take the confrontational approach.

10. CITY ATTORNEY’S REPORT:
A. 55th Street Vacation Po have agree4d to properties, prew working on legals cost went up 1200 in legal fees,
400-500 recording fees .
This is where we are at and as soon as we reieve the legals we can proceed approd $200
PER po at 9 po.
11. CITY ADMINISTRATOR’S REPORT:
Rafferty talked about mutual owater of interst, an FD organiaitonal, consider a joint rec
facility and they would like to partner with us, oakdale, Concil sugget I go forward and bring to the Parks Com
Le has been receptive, gave examples
Johnson/Smith dirt staff and get more details and take it to the parks commission.
MOTION passed 4-0. 12. CITY COUNCIL REPORTS:
DeLapp commend anne smith taking a call from, tom skalbeck and husband mediate a
successful resolution to that neighborhood dispute. May 21st, 8-noon wash cty fairgrounds
Code Enforcement to be brought to council committee , this will be brought in at budget
time.
